Question for Sylvia

What do you do when the title company asks you to sign as the closing agent. I don't feel that I'm the closing agent and refuse to sign it. I've had a SS call me back and ask me why I didn't sign in that spot. I explained to them that I am not the closing agent, just the notary. I am not making sure these borrowers receive their funds. Did I tell them right?

You did right.

in general, besides our notarizations, we shold sign very few places.

Off hand, we might sign such docs as:

I.D. verifications
Instruction page
and not much else. (varies by state, lender)

I have had that too before, I had the loan officer there with me so he told me to sign it.......so I just did but I was iffy about that too....that's a very good question though and I'm curious of the answer too...

You're right...it's a very iffy situation because if you read the paragraph underneath they usually say something to the effect of you're closing this loan and making sure the monies are being disbursed accordingly. Well, we're not doing that so, that's why I told the girl that I'm not signing in that area. Now, I have seen some ID verification pages that require you to sign as the "notary or closer". Those are okay, but not the others.

No, you are not the Closing Agent, cross out Closing and put "Signing"
I had a SS insist that I sign as Closing Agent, I called them and explained why I would't do it. The owner said it is just "semantics" and to go ahead and do it. I still crossed out Closing and put in "Signing" and didn't have a problem.

Maybe those of you that were on the old NASA board remember Susan Pense being called as one of the members had signed as "Closing Agent" and when the loan went into the secondary market there were problems as the "Closing Agent" didn't have the humongous amount of insurance necesary, and the loan wouldn't sell.

Thanks. Did you have to initial the change? Just wondering since they want you to initial all changes. This is what'll I'll do the next time I'm faced with this situation.

I have always been told that the closing agent is the title company. Not to sign there.
