Backdating Documents

We have been getting what I think are a lot of requests recently from so-called reputable companies regarding back-dating docs as well as up dating docs. The general perception is that this is bussiness as usual and when we refuse they tell us that they will just get someone else to do it. The threat of reporting the incidents are met with go ahead no problem, report it. We don't and will not ever do it, but it certainly is disappointing to know that someone is because the loans close. What is the reason to have a notary if this is accepted practice?

Hey Phil..Sherry from SLB here. I say let them go ahead and find someone else who will do it. It isn't their reputation on the line. I for one would never ask a notary to backdate documents and I feel that any company that would make such a request definately does not have the best interests of the notary in mind. I too get requests from clients to ask my notaries to backdate and I simply state that they are asking me to request my closer to perform and illegal act and I would not put my closer in that type of predicament. If they dont like it, they can go ahead and work with the agencies that are willing to risk their reputation and their notaries for the almighty dollar.

Sherry...you are certainly to be congratulated for taking that stand! It really speaks well for you and your business ethics.

Thank you Bob..No need to thank me though...why on earth anyone would want to put someone in that kind of situation is beyond me....Unfortunately, there are SS and SA's that ARE willing to do these kinds of things for the almighty dollar. It just isn't worth it to me and as I have stated before in here, I am currently in a year long legal battle with a TC to collect $5000 in legitimate invoices that they refused to pay because I would not ask my notary to back date docs. These TC's, Brokers and Lenders make enough money...they just need to have the docs redrawn and play by the rules but heavenforbid they lose out on some commission because someone wouldnt backdate...Money is the root of all evil I guess...
