Newbie POA question

I am doing my first POA this morning I could use some guidance. I am a little nervous.

I have the forms, and I am going to let them chose and fill it out. I am noting this in my journal. Their attorney told them that I would have them. I advised them that I am not allowed by law to give legal advice ect. They understand.

Fees: I am in california, and as I understand it I can charge 10.00 for cert, POA, and 10.00 a signature, plus travel fee and cost of the form (POA) Any advice?

Yes, you can charge $10.00 per signature. I'm not understanding the $10.00 cert charge. You need to let them know there will be a travel fee and a charge to provide the necessary form. You must also let them choose either an acknowledgement or a jurat. Not for you to decide.

In my book, it says I can charge 10.00 for POA, and it also lists 10.00 for a signature. The way it is written it appears that I can charge because it is a POA and for their signature.

My Ca State Notary Public Study guide. But, as I re read it, it appears that the extra 10.00 POA fee is for a Cert copy. And this is the original that I am notarizing. So the fee is 10.00
Tina where in Ca are you? Southern, North, central?

I went to my POA appointment and he was not there, returned in hour and still not there. She scheduled with me again for 3 hours later, but this time I called nfirst. He was still not there. So this has been a learning experience. I will try again on Monday at his play of work, again calling first. I will be charging 15.00 for the travel plus the forms, and the basic notary fees. This has been a learning experience!

Yes, near Camp Snoopy too!

Choosing PoA forms ...

Be VERY careful and keep good notes in your records.

The mere fact that YOU made the decision WHICH Power of Attorney forms the signer could choose from could put YOU in an attorney's eyes as crossing the UPL line. Even though you gave the signer a choice, it was a limited choice based on Your Opinion that you found all the available forms. If you are a CA Independent Document Preparer, then you know the issues. Would only become an issue if the Power of Attorney doesn't do the job it was intended to do.

A grey area. The ATTORNEY should have provided and completed the Power of Attorney form that was necessary for what his/her client wants to do. For example, in CT the "standard" statutory PoA form purchased at any stationary store needs to be modified to in order to be used for a CT real property transaction. If it isn't modified, it's no good for signing real estate deeds, mortgages, and related documents.

CA Independent Document Preparers chime in here. You know much better than I how to handle this and where the UPL line is.
