Privacy Notifications

As a Settlement company I am required to provide Privacy policies to the consumers that I am dealing with. As a signing agent I don't provide them with one. My question is when doing a signing for a SS that wants fax backs should we be disclosing this to the consumer since the SS in a nonaffiliated Third Party that is receiving personal information that is not of public record (note, TIL, RTC, Closing Statement)? Or should the SS be suppling them with one?

Interesting question! I'll be interested to see the responses and if any one knows the legal ramifactions of NOT supplying a privacy notification.

That is one I would definately save for a lawyer, and then again, the answer may vary depending on the state.
