Question re: absent signer on Deed

The notarial certificate for the deed has both husband and wife preprinted. Only he is at signing...she's out of town. How do you get both distant parties signatures on the notarial certificate?

She needs to be there to sign! Unless the SS has made some other arrangements to have you ship the dox to another notary where the wife is to finish up the transaction.

I called the Lender from the signing and told them I would need to line out her name and only notarize his. They said ok. But this morning they called back and said they needed to get both signatures on same certificate notarized. I should have known the answer but didn't.

As Sara_NV already said, the wife needs to be present in order to be on the same certificate. Since she wasn't, nothing to be done for it now -- and it's not your fault nor within your power to change, that is, unless AZ notary laws are substantially different than anywhere else OR if the husband (or someone else) has POA to sign for her.

In any event, since that signing already took place without her, it would still need an additional certificate for either the wife or for the AIF.
