Quick Question

Well I had a signing where the borrower was married, however, doesnt want the spouse to be anywhere on the loan, ie... the deed or anything else, the lender is saying the spouse HAS to sign the deed, even though he is not on it ????.. I am in CA.. does anyone know where I can get this info on our state law, I cant seem to find my answer, if I screwed up yes I will go out and fix it, but the borrower doesnt want him to be on it or sign it.. can they make her??? TIA

If the lender is saying the spouse has to sign the deed or any other documents, then that is the instructions you follow. Let the company know what is happening.
If they are telling you that the spouse has to sign and you do not get the spouses signature, yes you will have screwed up.

CA is a community property state. The Non-borrowing spouce must sign the HUD, TIL, RTC, and DOT.

even if the spouses name is not on deed, huh... man you live and learn... I guess that is one thing I havnet known all this time... thanks guys,... and they didnt tell me up front that the spouse had to sign but after, so I am off to find them and get them to sign,...thanks again !!
