mixed feelings on borrower recieving docs...

I've had a few signings where the borrower had the paperwork, this always makes me nervous. One case the papers were all over the place and I was uneasy about something being missing and getting blamed for it. Another had her pkt unopened.

I just re-confirmed a lunchtime signing, making sure he had his docs delivered yesterday. He says he had them and 'thinks' he signed everything he was suposed to, except he wasn't sure about the notarial sections....This is making my stomach knot. I'll be praying all the way there that he signed them correctly. Cross your notary fingers guys...

Isn't he suppose to sign in front of you?? Especially the ones that you notorize??

that's what I just thought! I don't know if he signed the ones I notarize yet or what? Now what? I am supposed to witness his signature

On every acknowledgment you ask him if he signed it, before notarizing it, he's acknowledging that he signed it . On the Jurats he will have to resign in front of you before you can notarize it. The rest of the document are O.K. if he already signed. I would check to make sure he signed in the correct place and any other information is missing. Also that the signature matches the signature on his ID.

I have had to use the brw's package before, as brw signed everything prior to my arrival, including notarized statements. TC says don't worry about non-notarized statements, just have him re-sign notarized statements. Some TC's now have 2 packets sent to brw with one packet written all over it "NOTARY ONLY-DO NOT OPEN!" This is a big help when they do that, as all the brw's I have seen have observed that request, to keep the pkgs separate. i hope that is the case for you!Good luck and best wishes.

As long as he acknowledges that he signed the ACK, that is fine. It is only the Jurat that needs to be signed in your presence. Many title co notaries you will fine do not know as much about notary law as you do.

I had one last week from FASS. The docs went to the borrower and when I got there he said that he had signed everything that he was supposed to. I almost had a heartattack! Well, they had the docs divided into 2 pkgs. One that he had to sign, and one that he was to wait until I got there to sign. It was a HELOC so there was only 2 notarized docs. But then you wonder if it is our responsibility to make sure that all of "his" docs were signed correctly. I actually did go through his and he had missed a few signatures and had initialled them all without his middle initial. These make me very uncomfortable. Also, instructions were for borrower to send them back----He asked me how to send them Fed Ex because he had never sent anything before. I wonder who would be ultimately responsible for all of these possible errors. What are these companies thinking???!!

Just to be safe

Had one once where borrower spilled red juice, koolaid all over the first 10 pages. Of course some of these title docs were not in borrowers copies. Wrote a note to title and lender explaining the condition of docs when I got there. Borrower swore they came from FedEx in that condition, but funny thing even though the docs were damp, the inside of the shipping envelope was dry as a bone:-) Whatever was spilled did turn those first pages a lovely shade of pink...

I would call him just to make sure he brings his copies with him so you do not have a second trip for them, it sounds like he did sign the notary pages that you have to witness. And easy fix if he does bring his copies.

OK! Just talked to him, he said he didn't sign anything that needed notarized...off I go with an extra dose of adrenaline coursing thru my bod.

I haven't done many signings yet, but my first one was a nighmare because the docs had been shipped directly to the borrowers! The borrowers docs had a big red stamp on some of the pages saying "Borrowers Copy"! That's pretty hard to get around!

It's an easy fix even if there isn't a second set of documents. If the borrower signed something where you need to witness his signature, you simply have him sign the same document again, above or underneath or next to his signature. No biggie.

Personally, I like when the docs are sent directly to the borrower because it usually means that the signing is going to go much quicker. I never review the docs before a signing, whatever they send me is what gets signed. It's not my job to do quality control checks to make sure the title company is doing their job correctly. If they screw up what they send me, they can pay me to go out again. In 2+ years of doing this job, I've never had an instance where this was a problem and I've saved literally hundreds of hours over somebody who thoroughly reviews each set of documents before a signing. And time is money baby!

And if the borrower spills on the docs before I get there? So what? Ain't my problem. The docs are still legal, they're just not as pristine looking. These things are out of our control so why worry about them beforehand?

Another Reason to Call Borrowers...

This is another reason I ALWAYS call ahead to my clients to introduce myself, brief them on the process and give instructions on "OK to open the package and read the dox if you'd like, but don't start signing anything until I'm with you."

ON ANOTHER NOTE for borrower receiving the docs...


BUT...glad to hear he didn't sign the pages with notarization needed.

On another note in regard to borrower receiving docs....I hate it because

1. they can have them all messed up (Charm)
2. Missing pages
3. Spilled something on it (Dog)

4. Or how about this one.......their dated for the NEXT day and you drove there for nothing! When HAD they been over-nighted to YOU. you would've reviewed them and see it and called to have it rescheduled and not wasted your time.

5. Or better yet....they get them that morning before running out the door...glance through it and realize that's not the terms they agreed to...didn't have time to call anyone becuase they had some seminar whatever....and never called the LO...and you show up and they tell you THAT story.
