looking for opinions.....

I have an Identity Fraud Prevention Affidavit before me, the wording is bit different. This is how it reads....

Above the borrower has filled in name, signed, DOB, SS#, and DL

Below

This instrument was acknowledged before me NOTARY on 12-12-2005 by ???(names or names of person or persons acknowledging.)

It just seems the by should not be there?????
