I did a closing for them, 11/24/04, that was called to me at 5:55 PM for 6:00 PM..O.K. a little late, but I was able to contact the borrower, download and print the edocs and have it all done by 8:30 that night....They said I saved the loan for them and was paying me top dollar.
Well I don't know who got my top dollar, but I sure didn't. I've called them, faxed, emailed, even sent them copies of the "famous" website. They pass the buck, no one is in the Accts Payable Dept. just voice mail and they don't return calls. Seems like there isn't anyone else to call and complain to. The Lender was Countrywide and the edocs went back to them.
So I know now that they should be put on my "IN YOUR DREAMS" list because that is the only kind of closing I'll ever do for them or advise anyone else to do.
It's really a shame that these big, name companies are stooping so low just to save a buck.
I'll bet they are referring to not paying notaries as "Cutting out the middle man".

Sorry this happened to you. It has happened to me on several occasions.

Hence, I have a new policy. I won't do any loans directly from a lender no matter how hard they beg.

I'll do it only if they upfront me the fee...period.

I know there are others on this board and elsewhere who have dealt successfully with lenders directly and have had few or no problems.

The trouble is, I haven't. All my experiences have been negative.

If you work directly with lenders, make sure you tell them that your name goes on the HUD's "notary fee" line. This way the title/escrow company has to follow RESPA guidelines and disburse fund to you accordingly. Btw, I'd keep a copy of the HUD with my name as payee.

I'd be careful about keeping a copy of the HUD. I think our friend GLB (Graham Leech Blialy?) might not be too happy to hear that you have a copy of someone elses personal finance information.

I may be wrong, but I believe only the lender and title companies are permitted to keep copies of the HUD. As a servicing third party, you aren't entitled to keep a copy, even though you are being paid.

This is what you do?: Fax over a 7 days to lawsuit demand letter (make sure that the demand letter is to the attention of the person who gave you the assignment, the AE does not want to be held personally accountable but he or she can be because you dealt with them), a copy of your invoice for the service including the name & loan number for the client on the invoice and a completed w-9 form for yourself. You will get paid. This happened to me and I read the posts on the board that told me what to do then all of a sudden within 24 hours after faxing that information over I got apologizing phone calls and paid within a week. I hope that it works as well for you as it did for me.

Jyhoward Thanks...I will try it. I know it couldn't do any harm. I'll even let everyone know if they do pay me, so maybe it will help their reputation (ha)

when you call them leave a message saying " I will give you 24 hours to contact me or 72 hours to pay me, if I don't hear from you or not get pd within 72 hours I will contact the department of real estate." when they hear the DRE they freek out, they don't like that; you will probably get your money from them.
