I thought I read something about it wasn't legal to highlight the documents. I did a search on it but, couldn't find. Any thoughts?

I don't know about it being legal or not, but I know there are a few companies that actually highlight the docs for you. Ameriquest seems to always highlight the escrow account agreement where the borrowers need to initial.... on every loan that I've ever closed for them.

I agree with the others - if you must do it use a sticky.

One time an insurance agent told me they weren't allowed to use hi-liters on certain documents because it appeared they were telling their insured what choices to make.

This has more to do with lender preference... some lenders will have a hissy-fit if you send signed doc's back where you highlighted certain areas... some don't care. As far as it being illegal... I've come across doc's for many states where doc's are previously highlighted by the lender. Your best bet... put sticky notes or removable tabs where you want to draw attention either for yourself or the borrower.
