Countrywide Doc Question
On the bottom of the Survey Affidavit, it has the
Sworn to and Subscribed before me, by ____________
Whose name goes in the by? My gut tells me its the borrowers name, but I want to be sure, before i incorrectly fill that in.
Also Countrywide has a form Attention Closing Agent, and it asks to list the fees for TIL Regulation Z. My guess here is I don't worry about that and its filled in by the title company... or do I fill in my fee under the "Courier/Closing Agent"?
Thanks!

The Borrower's names.

In my experience, usually it is the borrower(s) name that goes there. Usually when I add my name it is set up as Sworn and Suscribed before me, ________________, by ________________. Also, when it comes to fees, I don't make any changes to their documents as that is usually what they say. The only way any changes are made is if they ok or say to change/add them.

If you are in California, this wording would no longer be correct California Jurat Verbiage. You'd need to change it, use a stamp, or attached a loose Jurat Certificate to conform to the new California Jurat verbiage.

Terri, I am in CA and I used the new jurat stamp under the printed verbage on a form. Looked pretty "busy" to me, but couldn't think of anything else as the form was preprinted.
Is this what you do?

Yep, that's all you can do. Remember, while they may have prepared the form, the notary certificate area is your "domain." As a California Notary, you are the "expert" with regards to the proper wording, etc. Be sure to "line out" the improper wording so that it can't be filled in at a later date by someone else!
I, too, used the stamp on some documents this weekend. You're right it looks pretty busy, but one doesn't have a choice. As Joe Ewing (San Diego) posted elsewhere, and I agree, I believe that the companies will prefer the stamp to an attached loose Jurat Certificate. However, I had one set of docs that I had to use the loose Jurat Certificates, as there wasn't any room on the docs to use the stamp!
