Fair warning to all agents nto to work for this company.
Roxanne Wood at Genesis Title is probably the rudest, unprofessional individual I have ever spoke with. Let me get into the facts. Last Wed I was asked to get a closing done for her and I said yes. When I returned home there was no confirmation, nothing. Never heard anything and called and left a message for her about it the following day. Then today I get a call at 8am asking I do the closing for her that didn't happen last Wed and instead do it today at 4:30pm. Well, I said yes and when I got home I had the confirmation via email, I called the borrower to confirm and he said that they were to back date the docs to Friday's date. I told him I knew nothing about that but I was going to ask. When I emailed Roxanne and told her that under no condition would I back date docs she said she would check into it. Well, at 3:45 I get an email from her saying that they were having a notary at his bank do it and cancelling me. I proceeded to email Roxanne back letting her know that I will send the $50 cancel-fee for notice less than 2 hrs. She calls me, yells at me saying that she will never pay that because she has never been charged that by any notary and she has no contract with me anyway. I told her a confirmation of the closing IS a contract for work and she had contracted my time where someone else couldn't and that's what confirmations were...contracts. She hung up on me and so I thought I would warn all of you the business practice this company uses I guess.

Let me give you my take on the facts as you described them. I think what would bother me the most (and should bother you the most conceivably) is that she wanted you to back date the documents to Friday. I take it it must have been investment property, second home or something like that (i.e. - no right to cancel). Then I would be upset that there was no communication relative to the signing on Wednesday, no cancellation. That was totally discourteous, and if you wish unprofessional.

Now as far as your expectation as to the $50 dollar cancellation fee goes, did you respond to her confirmation (within a reasonable time framework) stating something along the lines "in the event of a cancellation less than two hours prior to the time set for signing, I will expect a cancellation fee of $50". If you didn't, you have to ask yourself OK what sort of notice did she have that I would be anticipating such a fee? Then she would have had the option of responding "Nope I reject the condition you have imposed upon the confirmation that I have sent you. In essence, what you would have done is send her a counter-offer or a conditional acceptance, if you will. When you get right down to it notice really is the key element in due process. And if you didn't enlighten her as to your expectations, then she really had no notice. So if this is the case, then I don't think that you should be surprised that she reacted extremely negatively to your request.

In addition, you could report her company to the State Department of Commerce or Secretary of State. This is an illegal activity--back dating. The notary that did the closing should also be turned in for the same reason. He/She would be notarizing a document that the borrower signed before him/her on that date.

I want to clarify...I'm utterly disgusted with her for one, asking to perform an illegal act and two for her unprofessionalism. She was aware of the cancellation but I think she heard what she wanted to get someone to do the job. I did confrom her about the Non-communication and she said she was sorry it got canceled before she sent the confirmation. I told her it wouldn've been nice to have known that though. My point was to warn other Notaries NOT to do business with this company because if this is how she acts now what makes you think she will pay or act any different if someone else hits her with the same thing? ps...you should see the nice email she sent me after she rec'd my invoice. In fact....here ya go, make your judgement yourself:

"You have lost your mind woman! I didn't back date documents! The borrower had his own notary in his building do the docs!!! We will not pay your cancellation fee!!! Take a hike!"

Nice huh??? But like I said...it was just put out there as a warning. To each their own.

I just want to clarify the comments that were made by Tyler Isenmann with Twin Cities Mobile Notary! I never ever backdate documents! This is an illegal practice! Genesis Title did not close the loan!

Despite your verbal abuse an invoice has been faxed to your office and a posting on Notary Rotary has been made referencing your actions. Should you not honor our contact and thus pay the cancellation fee when cancellation is made less than 4 hr. from signing time a claim will be made in court and you may be contacted by my attorney.

TO WHOM IT MAY CONCERN:

This was the first time I have ever called Twin Cities Mobile Notary. They have been black listed from our list of closing agents. We instruct our closing agents to include an invoice when returning the signed documents to us. As soon as we receive the package w/ invoice the invoice is paid. If you wish to charge a cancellation fee you should include that in an agreement before accepting the appointment.

Find it funny Roxanne that YOU changed the emails and

tried to make it look better for you. Black listed from your company. That is your choice. I think you and I both know you have lied in this matter and you will write what you like. I have no reason to work for your company and that is fine with each of us. You can though at least tell the truth as I did. It is too bad that some notaries ar too afraid to stand up to unethical SS or Title Companies. I am not one of them and I have no problem calling them out when they try to pull "crap". I don't think your deals have made my business any less. I have a good client base and they know professionalism and value the knowledge and expertise that I give them. I have the reputation of getting it done and right the first time. I have impeccable follow-through and communication second to none and that is why I have good working relationships with my clients and staff.

Good luck to you but a piece of advice...you get further in life when you tell the truth. Honesty and integrity are valued higher than trying to "save face". If you can't get the job done when it should be done (thus not requesting people to back-date docs) then you shouldn't take the job. Hmmmm, isn't that what the notaries are told by SS? Don't take the job if you can't get it done? Might "Practice what you preach" be some advice also? I think so.

We have a very good reputation w/ all of our closing agents and mobile notaries (over 500 nationwide). In my last response to your message I stated the TRUTH!

Tyler, if you were under oath would you then tell the truth? Do you lie so much that you believe your own lies? Are you a Pathological liar? I believe what you have done would be considered illegal. My advice to you is to "SEEK HELP" before it gets you in trouble.

What Tyler has stated in her messages is FALSE. I am not going to let her comments about my company or I affect how other (new) agents may feel about doing business w/ us. I have a very long list of closing agents nationwide that are willing to give written or verbal references for us. If you would like references please call me and I will provide them to any new agents or anyone that may have been affected by the comments made by Tyler Isenmann and Twin Cities Mobile Notary.
