Non-paying agencies

How do you deal with agencies that do not pay, or pay a lower fee than you agreed upon? I did four signings for one company. The first one was on July 30. The agreed fee was $75. They paid me $60 on October 21. The second was $150 (95 miles away) on September 25. Have not been paid for that one. The third was $100 on October 14. No pay yet. The last one was on November 24 (80 miles away) for $125. I received $75 for that one. I sent the company another e-mail this morning, and will be calling them. If I don't receive the agreed fees after this, what should I do--short of refusing business.

First of all let me state that your fees are way too low! You drove 190 miles round trip on September 25th for just $150??!! I can only strongly suggest you raise your fees unless you like not making a profit after you pay for your gas/mileage and wear and tear on your vehicle.

As far as this company you are talking about, first of all they are not only extremely late in paying you but you will very luck to get any payment at this point in time. I would send a registered notice with all invoices attached demanding payment in full within 5 business days. If you still receive no check then you can either take the loss or file in small claims court for the total amount due plus late charges.

I have seen several posts pertaining to this same subject and some have gotten results from daily phone calls and emails to get companies to pay. Try your best or just put it behind you and move on. BK-FL

First and foremost, I trust you have written confirmations of the agreed fees. You should send them copies of their confirmations with a firm letter requesting full payment within 10 days. Depending on your state, there are different ways you can pursue this. I guess the other question I have is if they are not paying as agreed (and very slowly) why do you continue taking assignments from them?

Short of refusing business? Why on earth would you NOT refuse business from this company? Any company that still owed me for a September signing in January is a company that I would never work for again.

You know how they operate. If you accept any future sigings from them it's nobody's fault but your own if you don't get paid.

You are so right, a company that I am still waiting for payment, called me before I left Cal for a signing. I advised them, that I do not do business on credit and that a late fee will be assessed net-30 from date of invoice. They promplty hung up when I gave my spiel

**The first was on July 30 ... paid October 21 ... second was September 25 ... third was October 14 ... lst ws on November 24**

You committed my number one thing I constantly preach about here -- Do not take on additional signings when you haven't been paid for previous ones. I would never have agreed to the September signing when it had been nearly 60 days since the first signing without payment. When they cut my first agreed-upon fee by $15, I would never have accepted the third and fourth signings since you had already done the second one. They are now two signings plus an additional $65 shortage in default. PLEASE use some common sense and open your eyes and DO NOT DO ANOTHER SIGNING for them until they are completely caught up. If they ever do completely catch up, do one signing and don't take another signing until they have paid for the first.
