Question / Debate
I seem to have a debate on my hands regarding the proper way to notarize and particular Signature/ Name Affidavit. The verbage is as follows .... Subscribed and sworn (affirmed) before me ___________(does the notary put thier name here or the name of the person they are witnessing sign the document?????) this 1st day of January, 2005.
Half of the notaries I work with put thier name and the other half write the name of the borrower.
Any input would be great to clear this up.
Thank you!!!!

It would say "before me," (note the comma) if your name was to be indicated there.

This document doesn't have the comma.

The signers are obviously not subscribing or swearing before themselves; they are doing so in front of (before) you, the notary. The notary name goes in the space.

Look at it this way. The certificate is YOUR statement with YOUR signature. Therefore the word "me" would refer to whomever is signing the statement, in this case, you. So, its YOUR name that goes there.
(Please excuse the capitalization. It is meant for emphasis, not as shouting.)
