Canadian passport for CA ID question...

Canadian passport for CA ID question...

Code 1185 specifies the following - when the ID used is a "passport issued by a foreign government"..."shall either be current or have been issued within
five years ... and shall have been stamped by the United States
Immigration and Naturalization Service"

SO - I was presented with a Canadian passport that was issued in Jan 2004 and will not expire until Jan 2009. The passport had NO stamp from INS. Borrower had an expired passport that did have the stamp.

I'm not up on immigration law - do you think he is here legally? Does his immigration status have any bearing on the loan? And finally, can the two passports be used to ID this person or were two credible witnesses the way to go?

You know, I've been to Canada many times, and they've never even asked for my passport. I'm wondering if it's the same with Canadians coming over here. Maybe the passport's legit, but they just didn't stamp it. Even in Europe, some countries look at your passport but don't actually stamp it. (I've actually asked them to stamp it for souvenir reasons!)

We asked the Canadians to stamp our daughter's passport when we went to Niagara Falls in 2002. They had us wait 1/2 an hour and treated us like we were nuts. I'm sure the same thing would happen at the Mexico boarder which is about 25 minutes from my house. They don't have time for tourists.

Visas are not required between US/Canada and US/Mexico - at least for the normal vacation visit. That is what leads me to suspect he has been here a bit too long.

Were you satisfied

of the borrowers ID. If so, then you fulfilled your obligation. Why does everyone think they need a DNA test.

I traveled for business internationally for 10 years. There are countries that don't stamp your passport.

I was satisfied - that is not the question - the question is weather or not the two combined documents would satisfy the SOS.

This is an interesting one. I'm not sure about your first two questions but I would have accepted his ID. Just out of curiosity did he have a Canadian drivers license? If so I would have used that.

No driver's license of any type - yet there were two cars in the driveway. Which of course does not prove anything. I'm just very glad that I have uninsured motorist coverage on my AAA.

When going thru Canada, they don't ask to see our Passports (not yet anyways), just some sort of ID... as in a current drivers license. I heard some rumblings that they will want to see our Passports in 2008 -- don't know if this is set in stone yet or not. So, I don't think Canadians coming to the USA need to have their passports stamped (they could use it as ID coming into the Country but, I don't think they stamp them).
I have heard that the Canadians do need their passports when going from one providence to another in Canada.

To be absolutely certain, call the board patrol or the INS.

This is also true for the US/Mexico boarder. It is good for notaries. Anyone who does not have a passport will need to get one - and the only way to get one in CA is to have an original certified copy of your birth certificate AND the only way to get that is to send in a notarized form.

Some people just won't go to Kinkos for a notary. I've done two so far - and 20 bucks is 20 bucks.

2 credible witnesses were the way to go. The one expired is no longer valid and the one not stamped means they are here illegally.
