CountryWide.. Signature/Name Affidavit...
Is now a Signature and name Certification and appears that it does not need to be notarized.. Anyone have experience with this? Am I correct in this assumption??? TIA...

Sorry I started my question in the subject... With Countrywide loans, the signature/Name affidavit is now a signature and name Certification, and it appears that it doesnt need to be notarized. I would like to know if my assumption is correct.

Is there a notary certificate ...
... on the document? If not, then signatures do not get notarized. If there is a certificate printed on the document, or instructions to attach a certificate, then make sure it is in compliance with your state (CA) notary laws and notarize the signature(s) of the signer(s).
This is true for ANY document. If there is no pre-printed certificate and no instructions to attach a certificate, then there is no notarization required.

Actually that isn't always the case. Just last week I had a company send a occupancy affidavit with no pre-printed notorial wording and no instructions to attach one, but I attached one. I was just curious if anyone had experience with Countrywide and knew about this form..

Why did you attach a notarial certificate? Were you instructed to do so? If not, you are guilty of UPL and in violation of CA statutes in that you decided to attach a certificate and of which type.

I beg to differ. Unless there is a certificate already in place, or you are instructed to attach one and which one to use, you cannot arbitrarily attach a certificate because you think one should be there. As I said, that is UPL.
Quite often I get documents that are titled "Affidavit" with no notary certificate. I do not notarize the signatures on that "affidavit". The signers are still responsible for the content of the document as attested by their signature.

I did a couple this week and one today
And none of them had a certificate to notarize anything. Must be a new glitch:-)

You are right. It is now a certificate and not an affidavit. Do not notarize. At least, in the one I did.

I just finished up with 2 from different offices and the name affidavit does not require notarizations, but always check with the lender for sure. Man..I am bushed, no more for me.. I am screaming uncle
