Get a load of this

I just received a chck from sirianni. The check was for a closing in October and is dated ------ 12/15/04. Hope it is good. I am going to cash it Monday morning and see if it goes thru.

all his checks are dated back to the time you were suppose to have been paid that way his business accounting looks to be right up to date and on time. He is still a scumbag. with a 90 day or more pay period.

My bank won't accept checks that old.

Checks are only good for 6 month from the date of issue. Normally. You may want to check what bank this is drawn on and if you are lucky go to a local branch to cash.

I was a manager at a Bank and checks are only good for 6 months and the 6th month mark on that check you have was June 15. Seems to me it might have been intentional, you can't negoitate the check so he ends up not having to pay even though on the books it looks like he did pay you.

Take the check and put it through as an ATM Deposit..... usually they just scan those checks after business hours.....

OR - you can deposit the check and post "Collections" on the Deposit Slip -- this means that the check check was previously not good and now may have sufficient funds

I would just stick it in the bank and see what happens. There's a very good chance it will clear anyway.

Several months ago I accidentally deposited a check made out to my business name into my personal account. I called the bank and was told to just wait, as they only physically checked about 1 out of every 3 checks. Sure enough, it went right through and cleared.

We recently did the same thing...

..and the bank returned ours! I double check every deposit now, since that was one of those little picky details that irritate the heck out of me.

My thoughts exactly, Sylvia. As a deliberate habit, I keep EVERY payment envelope and a copy of every check...I never know when down the road (a year from now???) I will need the address or even the name/check signature of perhaps a company that may now owe me for services rendered....

Pendaflex folders and manilla folders ...

... one manilla foler for each borrower; filed alphabetically in as many Pendaflex hanging folders as it takes.

One manilla folder for each signing service (title company, etc.); filed alphabetically in Pendaflex folders. Each contract, envelope, etc. gets filed.

One Pendaflex folder for fax logs. Another for advertising stuff, divided into manilla folders by type.

Lady Rouge (Sandi, she of the Red Hat Society) thinks I'm too anal-retentive in keeping the confirmation, driving directions, and my notes for each borrower. She rolls her eyes at my filing the envelopes that the checks come in. I hadn't thought of keeping a copy of each check, but that's not a bad idea.

No time at all really. I believe it vitally important to have all of this information and therefore, it becomes my behavior. Once I receive the docs/commitment, I print the confirmation, print directions (which has the mileage that I also log on spreadsheet), print invoice, attach overnite carrier (FedEx; UPS) shipping label; log invoice on spreadsheet and off I go.

When the payment check comes in, I pull inovice, attach envelope & copy of check, complete deposit ticket & again, off I go!

I also have all those Pendaflex folders....."Open" "Paid" "Info" - Info is all the contact/sign up info - W-9, contract, payment terms, and anything I've seen on boards pertinent to that company...good & bad.

Love this description of how to arrive at the grave. It reminds me of the name on the gravestone, its not the dash between the years lived, but how the years were lived between the dash.

Migawd, Ernest, I thought I was anally retentive! You're not just anal -- you're the entire colonic tract. I admire your perseverance, dedication, attention to detail -- all that good stuff. But I gotta tell you, man -- I admire Ms. Ernest a lot more. Do you file your used dental floss?

I save all the standard stuff: assignments, registrations with SS or TCs, fax covers, maps, etc. But envelopes? You're way outta my league.

... the floss frayes from the teeth of the file.

When I'm busy, the organization *saves* me time. Like Sheila_NJ, I print the directions and put 'em in with the confirmation. This way of doing things has been the only thing that has saved me when a last-minute edoc signing has come in when other signings were already scheduled.

One thing I'm doing differently now: I used to toss two pens of the correct color (blue or black, according to specification) into the folder with the directions. Now I just put a piece of scrap paper with "BLUE" written on it into the folder when blue ink is specified. I found that the pens sometimes fell out.

I did a signing on 8/10/04, check was dated 10/15/04 and was received 4/10/05. No problem at the bank. Good luck on your check.

I just got a check from him last week dated 2/15/04. I kept the envelope, too. I got a letter from my credit union today and was afraid to open it...I was so sure it was Sirianni's check returned for NSF! lol (Thankfully it wasn't!) How long do they take to clear?
I had filed a criminal complaint against him with the Nassau County DA's office. I let them know that I received the check and the details, they wanted me to fax them a copy. They were very helpful if anyone is still waiting for payment. Their # is 516-571-3800. They will mail you a complaint form immediately.

I'm sorry, I just saw your post today, NYNOT...I think it took approx. 2 months to receive payment after filing the complaint. The check hasn't bounced either! YAY!

Filing a complaint on Sirianni

I did a signing in early January and still have not been paid. Ater many attempts to call Sirianni's office - which some numbers have been disconnected, I finally got John on the phone at 516-882-0346 and was told to fax the order confirmation to 516-797-5300, which I did. I started trying to chase him down in May and finally got what I needed to fax him this on June 8th, which I sent along with a snide note asking John how he can work for this company and does he get his paycheck? I have since faxed it again and have still heard nothing. So to shorten it up, I sent letters of complaint, along with a wad of copies from Notary Forums to the following: Nassau & Suffolk Counties Grievance Committe, the NY State Office of the Attorney General, and the Association of the Bar of the City of New York. Low and behold, I got an answer from the bar association yesterday. They have no role in the investigation or discipline for misconduct of a lawyer. However, they did suggest contacting the Better Business Bureau and the New Yor Department of State, Division of Licenses, which licenses brokers and notaries. Hmm! Get the impression that they are not too pleased with the information I provided. I have Sirianni's notary and broker license numbers should anyone need them and addresses as to where to file complaints. Don't know yet where this will go, but have nothing to lose. I don't expect ot get paid so maybe one of these places of authority will put on some heat, or get him shut down! Will help any way I can if anyone else has problems or questions!
