LATE HUD?
If the HUD arrives AFTER you already left to do the signing meaning you now have to take it back the next day to get it signed, is that an additional trip fee that the notary can charge? The SS didn't tell me it was coming!

You should always call the SS first if you haven't received a HUD before leaving for the signing.

Since it is not a notarized document, they may be able to send it to the borrower and have them fax and then return it. Call the ss service and see how they want to proceed.

Fayth, I have to agree with jojo_MN on this one. Just call the SS and see how they wish you to take care of this. I have been told many times to proceed with a signing without a HUD due to in not being ready and that they would Fax or overnight one to the borrower.

Basically yes. You were supposed to not leave to the signing without having the HUD with you. You can call the borrowers and explain you are missing more documents and you will be late. Then call the SS and have them expidite the HUD.
If I already have a HUD and while driving to the Brw. or at the table, I get a call from SS or title co that it has changed, they usually will tell me what the changes are, manually correct them, have the bwrs initial the changes and that does the trick.
If after you have left the bwrs home, they want to change the HUD, then you have to go back and I would definetely charge, it is their mistake not mine.

Are you sure then, that it's the HUD?
Borrower's always sign the HUD and it's an extremely important document in the loan package. I wouldn't sign my own loan without one.

Cherilyn, I have a HUD with a pkg. in my hand that has no place for a signature on it. I will have borrower sign it . This is a first for me.

Sometime there is a HUD fomat with a separate page for signature. But as has been stated, HUD can always be sent to borrower directly..then signed and returned to title co. This has to be the most last minute updated document. Because I many times get calls that there is a new hud. If I am on my way in traffic, I don't go back.

Not all HUD's require signatures. However, when a HUD is prepared that doesn't require initials and/or signatures of the borrowers, then there is quite often a "Page 3" which states that they have read and agree with the numbers, and sign that page.
Also, quite frequently, the lender's HUD does not have a place for the borrowers to sign. These HUD's are created during the process when using software programs like DocMagic to prepare the docs. Title/Escrow companies then prepare the "real" HUD with whatever software they use. And these typically do have signature lines for the borrowers.
If there is no place for the borrowers to sign, I would not have them sign it. It could be construed to be UPL on your part.

.....and NO, it DEFINITELY has NO SIGNATURE LINE, so there! I simply asked the SS to ask the lender SEND the borrowers their OWN copy, and I sent the original LATE arrival back in the loan package. I'm done. And now.......I'm out!

UPL = Unauthorized Practice of Law
Something you do not want to do. By filling in forms for others or telling them what they should do, is not within your authority as a signing agent. Therefore, you may be guilty of UPL if someone really wanted to push it.

If the HUD has no place for signature and SS request that borrower is also to initial each page which does not have a signature line does this include the HUD? I had them initial the Hud.
