NON-PAYMENT OF SERVICES

Has anyone heard if assistance for non-payment of services is continued to be addressed by the NNA? I have yet another company that I performed a loan signing for and unable to get payment: Absolute Solutions "Chris D. Warren" Bradenton, Fl. I have been trying to get payment since 11/04. I have confirmed with the Title Company that he has been paid. He just laughs on the phone and tells me to call him another day. Avoid this Company, it is a joke trying to get paid. Other than the government agencies (BBB, DBPR,Attorney Generals Office, NNA) all of which I have reported to, the NNA should or NSA should post these companies on a site to avoid them.

I remember speaking to him about two years ago. He said that he pays $150.00 per signing. Is that how he enticed you? I believe you can get his information on the NNA site.

Send a certified letter to him to demand payment. Let him know that only a certified check for the full amount will be acceptable. Let him know he has three business days to get it to you, or this matter will be referred to collections, Division of Corporations, State Attorney General's office to report Fraud and Conspiracy to commit Fraud, Florida Department of Revenue, and the Internal Revenue Service, and the FEI hotline. Most of the information you require to get started is below. Send certified letters to both the addresses!

If notaries take a hard stand like this to get their earnings, these people will wish they paid the notaries when they see just how much it costs them in fines, audits, attorney fees, accounting fees, courts costs, interest, penalties, and possible prison time for possible income tax evasion.

If that does not shake him up, nothing will! Do this Quick!!!

I just checked my records. I provided a signing service for him on 2/24/2003. A total of 18 docs (34) signatures had to be notarized. My notes record that I had to make three (3) phone calls and two (2) faxed invoices to collect from him. I was finally paid $90.00 on 4/2/2003. I think 5 1/2 weeks with that kind of persistence to be paid is too much effort. I would never and have never signed for him again.

I have found that sending a formal collection letter, certified mail, can be a big help. I have invested in a "Past Due" stamp and the use of plain white envelopes--- not the security lined. That way the big red past due stamp shows throw for all the world to see. It was how I finally got paid by United Notaries. The wording of the collection letter should be firm. Give him only 10 days for the date of the letter, etc.

If they have an 800 fax number, I have found this works. Create a "request for payment or advise" letter and tape a black piece of construction paper to it. Make it legal size. Fax this "request" daily. They will surely mail your check when they're on their way to buy a new toner cartridge!
