Safe deposit boxes
Hey, just got an e-mail from a bank asking for a mobile notary to do drilling of safety deposit boxes that have unpaid rent behind them ---- I think it's bogous --- but anyone ever hear of such a thing .... and for that matter, anybody do the notarization that goes with it?
I'm at a loss......

Yes, I did lots of them last year! It is soooo interesting to see what people leave in those boxes! A rep. from the bank will be present and will go through the box and give you the description of the items to write down, after the locksmith drills the box open. After each item is logged, each person, (locksmith, bank rep. and notary) signs the form and you notarize it! I really enjoyed it, like I said, you'll see lots of neat stuff and it's a nice change of pace.

Monica - consult the Florida Governor's Handbook - the fees are listed there
Note: When notarizing the contents of a safety deposit box, remember to watch descriptions of the contents - if there happens to be a diamond ring in there, it is not listed as a diamond ring! It is a ring with a yellow metal band (if it is gold) and a clear stone. Gold becomes "yellow metal".. A ruby would be a red coloured stone, emerald - a green coloured stone etc. Be very generic in the descriptions.

Sylvia, Thank you for the "Note" at the bottom of your post. The information is 100% correct for the State of Indiana. As a notary you can not attest to a value amount on jewelery,# of carrats or even if it is real. " Be very generic in the descriptions" that is your main advise on this subject as noted by Sylvia

Description of the items
I can understand that one should not affirm that a ring is diamond without having true knowledge of that fact. Which party is providing the description of the items in a safe deposit box inventory?

That's strange. All banks have notaries. Why would they want you to do it for a fee when they have their own?????

a bank employee may no do any notarizing as to contents of a Safe Deposit Box here in Indiana

Conflict of interest. Besides you dont notorize somthing that you have beneficial interest. I guess; anyways I do I know?

Monica, please read your Florida Governor's Reference Manual and learn what's inside. It explains what needs to be done as far as opening safe deposit boxes, and why external notaries are needed.

There have been threads on this topic before.
First, be careful of what you're being asked. Are you being asked to do the drilling AND be the notary, or to be a notary/witness? If you're being asked to be the notary/witness and NJ law allows you to certify the contents of safe deposit boxes, then go for it! If you are expected to drill, then read post 16607!

I believe I received something a few weeks ago, that Florida Legislature changed rules that banks in Florida can now provide their own Notary.
I haven't been getting any more calls since that info came out.
Might want to check it out, in case the SOS hasn't updated the site yet.

I don't know what the Legislature would change, since there is nothing in the current FL Statutes (that I know of), in particular 655.94, that restricts banks from having and using their own notaries. However, since the person inventorying the contents of the box, the notary, must be "impartial", then it would be to the bank's advantage that a notary not in the employ of the bank be the one performing the inventory.

Hey guys,
Thanks for all the input on the safe deposit cracking case. I'm pretty sure the law in New Jersey on this coincide with your State of Florida's banks' laws --- But I'll be checking on it. As far as the fees I found out from my mentor that they charge between $25.00 and $50.00/hour just for notarizing. Seems pretty fair, if they have a couple dozen to open for the day.
