Two different Sig/Name Affidavits

I have two different Signature/Name Affidavits within the same loan package. Of course, one page is for her and the other for him, however, the bottom portion (where I notarize) is different. One reads as normally stated:


"Subscribed and sworn to (or afiremed) before me on this ___ day of ___ personnaly known to me or proved to me on the basis of satisfactory evidence to be the person(s) who appeared before me" Then I do the rest

The OTHER reads simply
"Subscribed and sworm (affiremed) before me" blah blah and then I do the rest.

Do I need the "personnaly known to me or proved to me on the basis of satisfactory evidence to be the person(s) who appeared before me" part. Is one the older version?

In California you must use the CA jurat wording that went into effect on Jan 1. Neither of the ones you listed comply. For the correct wording go to this link:

Thats what I thought. I have a packet of the Ca All Purpose Acknowlegments. Can I just attach a copy to the pack of this affidavit? Do I have to let the title company know before I staple a copy?

p.s. Jurat stamp

I also have a jurat stamp. Can I place that in an open area of the paper and fill that in? Do I need to cross off the old wording or is it obvious what I am doing by applying the stamp?

I was told in my notary class in CA that the jurat stamp is not recommended because most counties don't accept them.

They suggest using a loose jurat instead.

I wonder what they meant by **most counties don't accept them**? The DOT is recorded by the county. As far as I know in CA this is always an acknowledgment and never a jurat.

LMK if this is not the case please! If that is true then what type of form - other than a DOT - would the county have jurisdiction?

The proper acknoledgement wording is necessary for CA. In your case, you could place a line through the one that has the incomplete wording and write "see attached" and attach a loose certificate with the correct wording.

On the loose you can always reference to the line through by saying this certificate is attached to...page number....and date.

Regarding the Jurat wording, I never had a problem by having a Jurat stamp.

Jurat stamp o.k.

Since I was the one who originated the question. I just spoke to the title company and they need the stamp not an ack. Glad I called.
