borrower lied to
I had a lady I signed 2 weeks ago call me tonight. During the signing there was one thing they didn't want paid off, it was a car they co-signed for their daughter, they figured she pay off the business faster than she'd pay them and they wanted the money to fix up their house anyway. They wouldn't sign without lining that part out on the docs, I told them to call the lo and talk to him. She says she talked to her lo and all was fine, but now they got the payoff check and the car was paid off. She's call her lo (he hasn't called back) and she call the loan co, they say tough luck. I told her the only thing I knew to do was keep calling the lo I think it's to late to do anything. But is there anything else I should have said?

SOunds like you gave her the right advice. We have had clients call us if their checks did not arrive the day of funding. All we can do is tell them to call the lender.

I think your best option is to stay clear. Do only what you are hired to do as a Signing agent. I believe to do any more would be professional suicide. If the borrower calls you again, let her know this is between her and the lender.

I'm with Barry.
As sad as it is, and as badly as we all feel for the borrower, it just isn't our problem. The most we can do is be a witness if it goes to court. If you HEARD the loan officer tell the borrower, then that's A Good Thing. If you didn't, ....

Yeah, thats what I figured,
To stay out of it. I do feel bad for the borrowers though. nice old couple. All I heard was their side of the conversation with the lo, so I don't know how much help I'd be in court either. Man, when I get ready to buy I'm gonna really look for a honest lo (there are some out there- right?)

Barry, what great advice! Why do SA's think they are the document police?

to Barb
Just wondering how I came to a document cop? Frist the borrower called me, I would never have contacted them at all. Then which document was I policeing? I was pretty sure telling them to call the lo was the only thing for me to tell them, but I thought I'd check just to be sure. Document cop or not it does brother me when people ( particularly old people) are lied to. (even if there's nothing I can do about it) Just one of those "human" quirks
