Does Domestic Partnership mean Marriage or does it have other meanings ? Thanks

Speaking of my state of Gay 'ole Massachuetts...........
A Domestic Partnership I believe is not equivalent to a marriage. In my state we have common law marriages, we also recognize gay marriages.....
However MA notaries don't perform marriages like most other states. That job is up to Justices of The Peace.

I'm not preforming a marriage its a form in the loan docs I have not seen before. I just wanted to have an answer for the borrowers if they questioned this. Thanks

The California Domestic Partner Rights and Responsibilities Act
The DPRRA requires that domestic partners be treated the same as spouses for most purposes under California law. New Family Code section 297.5 provides:
Registered domestic partners shall have the same rights, protections, and benefits, and shall be subject to the same responsibilities and obligations, and duties under law, whether they derive from statutes, administrative regulations, court rules, government policies, common law, or any other provisions or sources of law, as are granted and imposed upon spouses.

Most other states don't allow notaries to perform weddings. Only Florida, South Carolina and Maine, and also West Feliciana parish in Louisiana authorize notaries to perform marriages.

Domestic partnership does NOT mean marriage. It basically means two people who have chosen to live together like a married couple but are not married. Can be opposite sex or same sex.

Domestic partnerships are an actual formality in California. The couple (whatever the mix) goes to the local city hall or county office and file paperwork that recognizes their domestic partnership. For some jobs, in order for your partner to be covered for health insurance, you must be a registered domestic partner.

California Domestic Partnership Specifics
In California a Domestic Partnership has specific parameters as per the SS of CA: "If you are in a committed lesbian or gay relationship in California, you can protect yourself and your partner by registering as domestic partners. If you are in a committed opposite-sex relationship where one partner is 62 years or older, you have the opportunity to register as domestic partners."

Domestic Partnership agreements/contracts are filed with the California Secretary of State's Office in Sacramento on a form provided by that office. To be legally binding this document must be notarized. The reason this document may be included with the loan docs is because the couple requested it to demonstrate their relationship in applying for the loan. The mortgage company can not require it. You can call the Domestic Partnership Unit of the Secretary of State's Office for more information at 916-653-3984, or visit the Secretary of State's website at www.ss.ca.gov.
