HELOC witness newbie freak out California
I just got back from my first HELOC assignment. There was a power of attorney form for the borrower to sign in case of any errors or ommissions on the loan docs. I notarized his signature on the form. Directly below this section there was another acknowledgement paragraph for what looked like a witness?? I'm not sure but instead of the word "borrower" by the blank it said something like "non-vested or non-interested party". Well I know I'm not a party to the loan, but I also know I can't notarize my own signature. Since California is a non-witness state, I just left that paragraph blank. Now I'm freaking out since I left blank spaces on a notarized form. Did I totally blow it? (please excuse any spelling errors as I am hyper-ventilating...)

I think you're OK. With experience you'll find that documents are full of signature lines that don't concern you at the time of the closing. I think they're used by title company staff, escrow people, etc. Don't sweat it!!!

Phew! I'm just worried since there was a place for the notary stamp. I'm hoping Wells Fargo will call if there was a problem. I'd hate to get a bad reputation without the chance to remedy the situation. It just seemed so easy - maybe that's why I'm worried....

Dont worry Ive just an e mail from my very first signign that I forgot to notorize the signature affidavit so I went over to the borrower s home and I took from their copy made a copy and fed ex to the lender

How long after the signing until you were notified of the mistake? I am hopeful that if 3 days have gone by with out hearing anything - that all is well...

This might sound nuts, but did you try and call either the signing service or the lender? Normally if I am walking into a situation where the borrower have the docs, I find out who I should be calling if there are surprises in the docs. I would rather be known as inquisitive and pesky by calling then incompetent by not making the call. If you are concerned about spooking the borrowers, make the call after you leave but before you actually depart the location. That way you can go back in as needed.

You mean be pro-active instead of re-active? Novel idea! I hope you can see I'm smiling as I type and not trying to be a smart-ass! Since it was my first assignment - i just didn't want to look stupid in front of the loan agent & borrower. I'd much rather look stupid on the message board which is why I'm not using my real name. I promise that next time I get flustered I will simply ask at the signing Have an awesome weekend.
