OMG.... These "hick" towns LOL
Shirley Police Department out of Massachusetts had called me about an hour ago. Can you believe that they are dumber then ............ (i'll be nice)....... LOL
An officer, who, for slander issues, we'll call LA... Well, tonight LA... actually had the complete nerve to call me up and ask me about a notarized return of service I did for a customer. I did, AT FIRST, explain to him that what I did was not illegal, I just notarized/witnessed a jurat, and administered an oath...... Basic Notary service
I was confused. The whole issue that the officer had was that my seal said "Commonwealth of Massachusetts." My jurat said "Commonwealth of Massachusetts Middlesex, ss"
The officer wanted to know who gave me the right to do all this. I told officer LA... THE GOVERNOR AND HIS COUSEL!! And mentioned that I was legitly commissioned, and that he can verify it, or I'd fax him a copy of my Commission Certificate...... Officer LA... told me that I am acting as the state of massachusetts and I face severe penalties! He went on and told me that I am not the commonwealth and I am not a court of law!!! WHAT AN IDIOT!
Anyways Officer LA... and I are going to go to the clerks office at the court tomorrow to see if I can "be" the commonwealth. HE'S IN FOR A RUDE AWAKENING!!! AFTER WHERE DONE.... AND BECAUSE HE WASTED MY TIME..... HE WILL LOOK LIKE AN IDIOT!
So much for these cops! Somebody please give them something to do!! I pay well!! LOL
I'll update tomorrow after I leave court. You know,,,,, you'd think they know what a notary public's duty is!

Why would you go down to the courthouse with him??? I would refer him to my states Government Code that outlines the duties of a notary public and leave it at that. Let him try to give me "severe penalties" and then we'll find out about slander. I can't stand ignorant, moronic, brainless people with an attitude because they are in a position of perceived power.

I completely agree with you and I did direct him too the states general laws, and the New revised Executive Order explaining Notaries Public for Massachusetts.
It is my choice to show up at court because the officer stated that he's going to the clerk's office first thing tomorrow (which, on his end is pathetic and a lie because tomorrow is SATURDAY), which I think he means monday, but let's not correct him.
Given the fact that he threatend me with filing a complaint and an issuance of an arrest warrant, I would love to be there monday to see the look on his face when the clerk corrects him. Then, after he's corrected, with him standing there, I'm going to make the officer feel really dumb because he wasted my time.
He should have never had an attitude with me on the phone!
Okay... that's all jon LOL

So you're going to waste a considerable amount of additional time just to make the officer feel dumb? Just because of his attitude toward you on the phone?
How dumb are you going to feel if he doesn't show up at the clerks office?

Reply by Korey Humphreys on 3/5/05 12:07am Msg #23740
No I wouldn't feel dumb because I'm doing whats right: sticking up for myself. Besides my whole intent is too lodge a complaint regardless if the Officer shows up or not.
He's a Police Officer I'm a Public Officer.......... I don't mess with his job....... he shouldn't mess with mine. Plain and simple.

If this happened in my neck of the woods, it would mean the cop is "gunning" for someone. If he weren't on some crusade, he would not have even bothered to call you on such a matter. Hopefully, he'll forget about it. If he doesn't, you might need a lawyer or at least the SS's office in your State.

PLEASE, PLEASE, PLEASE keep us updated on this one! I think I would also take my time to show up..the threat alone would warrant my attendance and the pure satification I would recieve from seeing someone else telling him he's an idiot after that on the phone would be worth it.
I do though wonder, why he called you in the first place? Who told him to? Did someone make a conplaint or something?

I will keep you update believe me!! LOL
When someone serves a Notice of Trespass the process server has to return a "return of service" to the local police station so the police can enforce it if it's violated.
Given that I administered the Oath to the signer of the affidavit, and issed a jurat certificate for the return of service, my name was on the document turned in.
CaliNotary thinks I might look dumb if the officer doesn't show up. I told her that I wont feel dumb because I'm standing up for myself. Regardless if the officer shows up or not, my intention is to file a complaint.
He is a Police Officer....... I am a Public Officer......... I don't mess with his duties..... he shouldn't mess with mine! Plain and simple!!!

I agree that he shouldn't have jumped the gun and spout off without doing his homework and checked into your abilities first. I agree THAT warrants someone (his superior) knowing and thus maybe (one can only hope) that his superior will maybe make this example a learning experience for all his officers so as to not have his officers be idiots. AND when talking to his superior, I would point out that his officer SHOULD know the process to be able to successfully enforce the tresspassing. Did that make sense? Hope so since I'm not from MA, but it's what I gather from what you've explained as the process.

Reminded of a story
I was once told the story of a dog sitting by the railroad tracks A train came by and cut off the tip of his tail The dog got so mad that he turned around and bit the trian, which proceeded to cut off his head This cop will not get any smarter by being confronted He has allready established himself as a jerk I see no point in antagonizing a jerk that happens to have a gun and the right to put me in handcuffs, and then later say "oops" My dear, departed Daddy, once told me that you never want to get into a pi$$ing contest with a skunk- all you will accomplish is to end up wet an smelly Good Luck

The police officer will self-destruct. I would think long and hard before doing something that would alienate the police. Chuckle (or laugh out loud), say to myself "What an idiot!", and move on. You're not going to win when you fight the long arm of the law.

There are times that even if you win the fight, the battle is far from over ... and, just say, even if you win this fight and prove to embarrass the police officer, the fallout and/or repercussions will be far but over, and you will, in fact, end up the loser. Walk away a much taller person and gain a lesson in maturity by not pursuing this particular fight.

Re: NOT with Bob and Dogmonger
Well, I can see where you might want to walk away. BUT, I do feel that the police, etc. sometimes take their badge or title one step over lines and think THEY have a right to bully JUST because they wear that badge. I think, why not stand up for your rights when you have LAWFULLY done your job and done NOTHING wrong. Going and standing up for yourself is not a quest for EGO boosting. I think it's a right to represent your side of things in an adult manner. Now don't go "...nana, nana, boo, boo...I was right!" but just appear on your behalf to show you did no wrong.
And it's up to you but that's what I would do.
Otherwise, I feel Bob and Dogmonger...what's to say that noone has ever stood their gound to this guy and he's just getting worse throughout the years as an officer and one day he thinks in his mind he has a "right" to do or say something because he "thinks" he knows something that he doesn't and BAM, something really bad happens (who knows what). But this could be the path the officer is suppose to cross in his life that changes the way he might think about things. It's just a thought. I just wouldn't tell my sons to just retreat from what they believe JUST because someone else might hold a higher authority. I would hope they would not but rather explore it in a responsible way to learn from it.

**** This by the posters own admission is not about standing up, it is about getting even. Given the fact last week that this same poster was chased by a irate husband who was served with non contested divorce papers and had to mace that person and have him cited by police. Given those circumstances and the fact that they still serve, perhaps it would be to their advantage to have made a friend of Barney than to allienate him. Well, Dogmonger....I've been doing signings for about 5 years now...more than 5000 done...and have had but ONE, yes only ONE company ever try to NOT pay me. AND I did get my money...and I put their "BUTTS" in a position where they knew I don't "F*&%" around when it comes to business AND they are now one of my biggest customers because they know they are dealing with someone who conducts business to get it done! So your damn right that I would show up AND not for vindictive reasons but for NOT to be pushed around. I HAVE, like Korey does, the right to conduct business and NOT have someone think they can walk all over me. And if the police officer has ANY intelligence he will learn from this AND show some damn respect for Korey knowing his job/responsibilities and know whenever he sees Korey's name on something it's legit!!!!!!!!!!! Get it? Maybe step out of your box to know that everything is a learning experience...whatever end you are on...and nobody HAS to be vindictive or childish in this situation at all. It would be childish to go and say something stupod to twist the knife. But to show up, if the officer "get's it" he'll turn around and apologize and shake hands and part way.
What's wrong with that....

Re: Just my opinion...
What's wrong with it is that the officer already said he was going to go to the clerk's office and find out the answer. Assuming he does that, and finds out that he was incorrect, what additional purpose does it serve for Korey to show up? The only one I can think of is so she can gloat in his face about it. To me, that's pretty damn childish.
Ya know, I love that when posters on this board (like me and some others) bluntly point out ignorant questions or mistakes to notaries who should DEFINITELY know better, we're called rude, nasty, mean, bitchy, lacking a sex life, etc.
Yet when this officer, who is most likely NOT a notary, shows a similar ignorance, there's a whole fan club cheering Korey on to put him in his place. Shouldn't our standards be higher for ourselves than for non-notaries?

This is true. IMHO I would show up and after it's all over be professional and don't gloat; Police officers don't exactly relish being mistaken, if that will make you feel better just don't treat him like a puppy and rub his face in it, as it tends to lower you to his level.
If you want to erk him that bad, again show up and present your most professional behavior, afterwards don't give him that which he would expect from some one of his caliber.
There is nothing wrong with standing up for yourself, show a little tact and remember,... "Consider the Source", it gets easy once you do that! That way if you do for one reason or another need his assistence in the future he'll remember that also.

Speaking as a former resident of a "hick" town in Massachusetts (Belchertown!), I can sympathize with you... Although, from what I remember, don't Sheriffs often serve documents there? I wonder if you could find out how returns of service for docs served by the Sheriff are notarized. I'm sure they'd also have "Commonwealth of Massachusetts" and the county listed.

My final opinion after reading
Okay, I thank you all for your input. Seriously.
However, after reading everything I ask myself, "If the officer get's away with trying to intimidate and bully me..... What's the officer's next step with myself or another notary?"
I was raised to stand up for myself regardless of the consequences. What matters is that I'm in the right. If, for whatever reason, I was proved wrong, then I would be man enough to face up to it by looking the other person in the eye and apologizing.
In my line of work, (paralegal investigator; advocate; process server, etc.) I cannot have the image as someone easily pushed around.
We all have our opinons and thoughts. Mine is more moral in a sense. So, I respectfully thank you for your input once again. However, I must do what I feel is right.
======== Korey
P.S.: I'll still update Monday afternoon for those who want to know the outcome.
