I actually had an LO ask me if I could just "make up a witness"! Wow.

I would tell him (that is if this was for the mortgage) that Florida is not a witness state so witnesses are not required. If he wants to "make up a witness" that is his prerogative but you will have nothing to do with it.

If it was for a document that did require witnesses (quit claim deed, warranty deed, grant deed etc) then witnesses would have to be there to witness the signing. It is up to the borrowers to get the witness not the signing agent.

I would have asked the LO to fax me explicit instructions for "making up a witness". If the LO was dumb enough to do this I then would have faxed the letter to his boss, the SS and the title company. People who ask us to do something illegal need to be drumed out of the business.
