When a drivers license expires just two days ago and thats all the signer has can you use that ?? I think you have 90 days to renew a license.

Depends on your state's notary laws. You didn't say where you are located.

Here in Florida, if it had been issued within the last 5 years I would have accepted it, if not I wouldn't.
