MCLA 565.201 Michigan recording requirements

This is an exerpt of Michigan's recording laws.

This revision came about in 1997, a few years after I left ROD (Register of Deeds):

(iv) Is legibly printed in black ink on white paper that is not less than 20-pound weight.

Now we know that this is referring to the body of the document, the preprinted part, but the county corporation counsels have determined that this means ALL PRINTING AND ALL STAMPS, but not signatures.

It is just easier for the lenders to require all black in Michigan, instead of stating that blue for signatures was okay, but all printing must be in black.

A lot depended on how the county was enforcing this rule. Things have slowed down a bit, to the county employees get pickier so they have jobs.

Julie,

Have not called the Oakland County Register of Deeds office yet, but plan to. Do you want to call the Macomb County Register of Deeds office to see what they say? TX.

No Ted I'm not going to call. Here is the number if you want to call: 586.469.5109.


The reason for not calling is that you have to deliver what the client wants. If they want black ink, I give them black ink.

If you really want to call someone, don't make it the register of deeds offices. They only enforce the rules they don't make them and they don't change them. You may want to try the State Attorney General and see if the have an opinion or call the Michigan Association of County Clerks.

We don't need a notary stamp in Michigan, but all of our clients want us to use one.

This is not one of them as I want to make money. Ink color is no biggie to me!

Hi all,

Here is exactly (a quote) what Washington Mutual has specified:



Ink Color: In Michigan, Washington Mutual REQUIRES BLACK ink. WAMU
recommends black ink for signings in all other states, though BLUE ink is
okay at this time.


Why they seem to have singled out Michigan I honestly don't know.
