Background Checks and UPL Agreements

I have had 4 title companies within the past 2 weeks fax or email me the forms for them to perform a background check and to sign UPL agreements. They did not ask that I pay as some other cos. have. I refused to complete 1 as I just don't do enough business with them. I asked my contacts what is going on and the general consensus is that everyone else is doing it so..... Another contact said they wanted to be sure to have all their ducks in a row (for duck hunting, I don't know). Another wave of the future. I think the UPL could really get out of hand. We know how some customers can be with he said she said or simply misconstruing and/or misunderstanding what is said to them. It really would be the notary's word against the customers'. The line we walk seems to be getting finer.

Seriously, they NEED a background check before WE do business with THEM! lol.

These were all title cos., not signing services. I typically have no trouble with the title cos., but I agree with you about that in regard to SOME signing services. I don't think they need a background check as much as they do a capital in reserve/payroll/integrety check.

UPL = Unauthorized Pactice of Law

Most notaries are not attorneys and are therefore forbidden to do things that attorneys can. Like offer legal advice and provide legal opinions. Notaries, like attorneys can lie and cheat, but it is not ethical or professional for notaries to do that. Smiley

If you want to try and convince a jury that your client is innocent, dispite the video tape, 4 eyewitness, 3 DNA tests and a confession by his partner, you better know how to "hedge the truch in such a way, that the jury will believe the opposite"

Ilona, I think UPL means Unauthorized Practice of Law. If I'm wrong, I'm sure someone will let me know. I had to guess since UPL is used often here.
