Certifying a Limiited Power of Attorney

I have never been requested to certify this document in a loan package. I've only notarized (acknowledged) the document.

I received 2 copies of this document, one with the statement at the bottom of document:

CERTIFIED TO BE A TRUE COPY BY:________________________

Is this for the TC or Lender to complete and sign???

I think you're supposed to sign it, because you're certifying it, but I would double check w/ someone else....check your law primer book if you have one. Smiley

It's for the person making the copy of the original doc. In most cases, it's for Title. However, there is one NY TC that sends 3 copies of the mtg. with this stamp on them. I asked them how I could "certify" that they were copies with wet signatures on them. Duh!

Some TCs try to do their work in advance.

Also - check your State laws re: certifying copies.

If this is a POA pertaining to the signing ie: wife signing for husband, the TC, in most cases, needs an original to record with the Mtg/DOT.

In Title, I certified copies from originals all the time. Many Cos do not require a Notarized certified copy only a certified copy. Does that make any sense?

Yes, it does and thank you Becca.

I am allowed in my state to certify copies, but I just wasnt sure if I had to be the one signing the CERTIFIED TO BE A TRUE COPY line since I was the one that notarized it.

I've never seen it before.
