Medical affidavit records sent previously
I have been notarizing some medical record affidavits recently. At the last one, the firm needing the records and affidavit had already sent someone else to pick up the records, and I was just to notarize the affidavit. The affidavit had the affiant state how many pages of records she was submitting (or in this case had already submitted). So, I did not pick up the records and send them in. Is it okay to still notarize the affidavit?

You only notarize when someone appears before you, acknowledges the documents are accurate, and signs the document in your presence. Is that the case? Vicki/MD

Yes, that is right. It is just that she had already sent in the docs, so I was notarizing that she had 30 pages of docs, but not on her for me to pick up.

Yes, as long as the person appearing in front of you is stating that they know how many pages were previously sent. You are there to perform the notarial act, not certify that the correct information is listed. That is what the person in front of you signing does. You're witnessing their statement that the information is truthful.

We could argue all day over the technicalities of doing this.
The reason this is happening is the office personnel is in denial that they need a notary.
So, they gather up the docs, sign and send them in without a notary's certificate.
When the lawyer/lit support firm gets them back, they call you to go out and get the signature.
Notice that I am not telling you one way or the other to accomplish this task--not stating that it is right or wrong. I have gotten two different answers from the SOS office on situations like this.
