On this _____ day of __________, _______ befire me personally appeared __________ yada, yada...Here is what I'm stuck on. ...who executed the forgoing instrument, and acknowledged that _________ executed the same. Do I put my name in the blank before executed the same?

Holy Cow!! Scary is not the word for it!! Every notary worth their salt has All-purpose acknowledgements, Individual Acknowledgements and Certification of Identification in their briefcase. And an asst. of other forms in the portable file in the car!! Anyone that doesn't have that wording down "pat" by now!! Yikes!! What are they going to do when the venue is not printed for them ? Let the lenders fill it in ? We could go on and on but I will not bore you. Like I've said mannnny times ss are sure going to get what they paid for "Trouble," more power to um!! Carolyn, don't even get me started on fees again "The Notary Fee Auction" as I like to call it. I really did try not to make any comments, but this one is just Silly!!!

How many Premier Members will re-up on this board ? How many Basic Members will re-up.
To spoon feed $35-$40-$45 notaries, I'm surprised they would even pay the fee to be on any board. I suggest to All Newbies Read and Learn from the same sources that we the experienced notaries had to learn from!! Fellow Experienced Notaries the only way anyone learns is to #1. Read #2. I agree with you totally. But look at all the members on this board that ANSWER THE SAME QUESTIONS OVER AND OVER FOR THE NEWBIES. They are also at fault. Like mother hens. I am a premium member who will not renew.

I've gotta agree with this. I'm sure these board members think they're doing a good thing and being helpful, but all they're doing is making it easier for incompetent notaries to ruin our business.

NNA offers bad advice - "NSA Today"
In reading the Fall 2005 issue of "NSA Today", I found some statements that are questionable or just plain wrong.
For example: Page 5, "Planning Prevents Havoc With Last Minute E-Mailed Forms". About half way through, there is the statement, "It is essential that Signing Agents have the right hardware to accommodate e-mailed documents. An up-to-date computer system is required along with a laser printer that can handle different sizes of paper and prints a minimum of 25 pages per minute (PPM) in black-and-white." While I agree that state-of-the-art equipment is wonderful, but certainly not necessary, as long as it meets the needs of the user. Many NSA's are still using Windows 95, 98, 98SE, ME and 2000 on systems that have Pentium II and III processors. Also, 25 PPM is nice to have, but again, not "required". Of course, faster printers may afford the NSA quicker printing, but not always, as most of us in the real world already know.
Another example: Page 5, "Renew Commissions Promptly", second bullet. "... (a three-hour course and exam for renewing Notaries in California, for example) ..." To my understanding, the CA training requirement is 6 hours.
Final example: Page 6, "Clear Communication A Must". "Direct communication can be achieved through a variety of means but should not involve a third part acting as an interpreter." While this may be true for some states, it certainly isn't true for all of them. The Florida Governor's Reference Manual for Notaries (2001) states, "If the signer does not understand English, make sure that the document is translated into a language that the person understands." On page 37 of the manual, there is the following specific instructions:
For a person who does not speak English §117.107(6), Fla. Stat. The nature and effect of the document must be translated into a language that the person does understand. The law does not specify that a written translation is required; therefore, an oral translation is sufficient. You may wish to add a statement in your notarial certificate that you have complied with this requirement of the law: "I further certify that the nature and effect of the document was translated for (name of signer) by (name of translator) prior to notarization." You may also want the translator to sign the document and your journal.

You would be surprised (okay, maybe not) how many attorneys, even title, real estate and estate planning attorneys do not know or comprehend the notary laws of the state(s) they are licensed to practice in. Just look at some of these forms (affidavits, for example) that start out "being duly sworn", or "under oath" and what type of certificate is at the bottom? An acknowledgment.
