Important question
Did a signing for a couple, got a copy of their ID's, had them signed , then realized that her ID was expired. I called NNA and the secretary of state and they said it had to be a current not expired Id. I need to send the docs back, Do I cross a line thur the docs that they signed. ?? I don't want anyone illegally notorizing the docs. Please give me any advice that you may have. Thanks

see if you can get the borrower to give you two forms of id , one with a picture, call the secretary of the state again and see what other forms in your state are acceptable as a picture id. this isnt legal advice, just a suggestion, but your state secretary would be able to help. good luck!!!!

Since you don't say what state you are in it is hard to help you. You may need to call the signing company or tc to see if you can use two credible witnesses and resign the borrowers.

Check your state handbook. There are usually other ways to ID someone. In some states you can use an expired license if it has been issued within the last five years. Call borrowers and see if maybe the new expiration date is on the back of the license. Ask if they have passports you can use. Can you use credible witnesses? Call the SOS back to see what else you can use to ID her. If you cannot come up with a valid ID, the only thing you need to VOID is your notorial certificates and be sure the SS or TC knows you did not have a current ID for her.

When doing a signing the very first thing I do is enter the signers information in my journal. With their drivers license number I put the issue date and the expiration date - so I would know upfront whether their ID is expired or not. If the license is expired, then I will not continue until they can give me acceptable ID

What does that mean? Was someone supposed to notarize them after you had them signed, or am I misunderstanding the statement?
