Please Help! Not sure what to do here....

Late today I received a call from a company re a refi for tomorrow...he said that one of the borrowers had lost her drivers license while on travel, had gone to apply for a new one, but had to order a birth certificate. Still hasn't received the BC, and doesn't have that or a current DL. She has an expired license (about two years ago), but that is the only picture ID. The escrow person said she has a "credible" wittness who would swear that she is the she claims to be. I told the escrow person that I would do it, but that I wanted to speak with the person first and set the time, etc. I wasn't able to speak with her earlier, so now I am having severe misgivings about this. The escrow person already sent me the confirmation and docs. I know that CO law states that she must have current ID, or a credible wittness, etc. I don't know who the witness is....

Would you call the escrow person and cancel out on this?

IN CA. IF THE ID HAS BE ISSUED WITHIN THE LAST 5YRS YOU ARE ABLE TO USE IT EVEN IF IT EXPIRED. BUT THE CACTH IS CA ID'S ARE GOOD FOR 5 YEARS SO YOU STILL WON'T BE ABLE TO USE IT IF EXPIRED. IF YOU HAVE YOUR NOTARY BOOK HANDY CHECK FOR THAT RULE.

This is a question about Colorado law, California law is irrelevent to the situation.

And you're not entirely correct about the CA law either. Replacement driver licenses have the same expiration date, but a current issue date. My driver license can legally be used for notarizing me for 3 1/2 years after it expires.

No can do...

Acceptable identification includes a current identification card or document issued by a federal or state government entity containing a photograph and signature of the signer. The notary may also accept a sworn statement of a credible witness who is personally known to the notary and who states that he or she knows the signer.
