West Virginia Closings
I'm rather new to the business. I've searched this site and discovered that WV is an attorney only state. Am I correct to read that only attorneys can perform loan closings? I have been a paralegal at a lawfirm for nine years. The lawfirm I work at does not handle real estate transactions. If only attorneys can perform loan closings, why are title companies and ss contacting notaries to do them? I do not want to be doing anything unethical. Any advice you can provide would be much appreciated. Thanks.

I close loans only for attorneys. I am appointed by the attorney and carry an authorization letter with me to give to the borrower. According to the WVSOS, you must be appointed by the attorney who reviews the documents.

I had struggled in the past with this one....so, i contacted the office of Betty Ireland. I was told that when a signing service or a title company calls me for a closing, I should ask for the name of the Attorney reviewing the documents. So, I started asking and......none of the signing services were aware of WV being an attorney state. You have to be careful to cover your bases. I too stay safe by only closing for the attornies who provide me with documentation. Market yourself to the law firms. And do not let the SS trick you into anything illegal.

I already contacted the SOS and was referred to several people who couldn't answer my questions. The title company is an attorney in Parkersburg- I am in Martinsburg. Does this make a difference? Thanks so much.
