Borrower goes nuts
I did a signing this morning for a borrower for the second time. The first time was at the end of last month annd met her in front of her office uptown after parking and she then proceeds to tell me she has a meeting in five minutes, I told her this is anywhere from 45 minutes to an hour. She says well I will have to reschedule. (not much common sense, if I was told the time was no good I could have rescheduled it later that day)
well I was told I would get trip fee for that, now it was rescheduled again and I was given the assignment once more plus this time its edocs so a higher fee, the hud never came by the time i had to leave so I had title co email it to boorower, I get to her home and she was cordial but aloof. she kept getting up to work on her laptop and then signed docs, checked email several times and when we were finished the hud still wasnt there. I told her that I called them several times and I was told over and over its a few minutes, she says for me to not say one word she dont like my attitude and if I say anything she will have me leave. I was not trying to be a smart ass but told her I cant stay to long, finally hud came and she wouldnt sign the amount she was to get back she felt was 500 lower than she was told, so of course I said she will need to talk to LO and I called title co and they gave me a contact for suntrust, which was a voice mail, meantime this woman is making me nervous and was not happy. I told her the 3 day recission and she could sign and straighten numbers after I left. Finally she comes and signs hud, I told title co I was on phone with ok she signed hud im on my way, she flips out and says thats it your out of here and grabs the papers from me and proceeds to rip them, she threatens to call the police and shoves me out the door and wouldnt give papers back after all were signed. I was in shock and besides being in a bad part of town a little nervous.
What a day and that is only the morning so far.

Goodness! I cannot even imagine. So Far I have been lucky, most are super pleasant. I most likely would have left when she told me that if I said anything she would make me leave. I wish borrowers would not take it out on us.

Wow, I think if anyone "pushed me out the door" or layed hands on me in any way, I would call the police and report an assault.

Depending on your location, you would report a case of battery; the legal definition of assault in some areas is "the non-physical threat of violence".

Re:No Mitch, you're not quite correct.
An assault is the threat or use of for on another that causes that person to have a reasonable apprehension of imminent harmful or offensive contact. Battery is the use of force against another. To shove someone out of a door would constitute assault and battery.

I am so sorry for you to have to go through this. She must be a very strong lady to rip the loan documents to pieces. I have had my share of borrowers try to "go nuts" on me or show me that they indeed are the "boss" of me. When they state to me, "You work for the mortgage company. Why can't you advise me financially", I reply "Good Lord, No! I own my own company. I can only tell you what the documents are. You have to ask your loan officer about your financing". Others have told me they have a meeting in a half an hour. The quickest I can do a set of documents is 15 minutes with no questions asked, just signing and sealing. The mortgage company so I've been told states it can be done in 5 minutes. Wow! show me how it's done, Mr. Loan Officer. Until then, I don't believe it.

Remember KeViN/NC??
I don't know if you remember Kevin/NC the Attorney from NC who NEVER closed loans in a single woman's home and many people argued that was rediculous. My first thought reading your post is this never would have happened to him - right or wrong. I sure hope you were on the phone with the title company when she went nuts and they heard the whole scenario.
Good Luck with this one.

Re: Remember KeViN/NC??
Joan,
I was on phone with title company as this was occurring and they heard every word, they kept saying are you alright?
I was telling them as the the lady (word used loosely) was tearing some of the paperwork as she was doing it. I tried to grab both copies but she pulled them and then proceeding to move me towards the door threatening to call police. I should have put them in my briefcase as soon as she finished but was waiting for her to sign hud. short sighteness is 20/20.
The title company rep says she will send email to superiors and lenders and felt I would be paid full fee.

Last summer I had one crazy borrower too. I should have known from the beginning, he was very rude on the phone. He received a copy of his docs courtesy of the LO on Friday (docs to be signed were FedEx to me). He was supposed to review them and confirm an appt time. Of course he can't get to reviewing them Fri (although SS and TC keep calling about the docs being date sens). His time is too valuable and he doesn't feel he should be forced to conduct business over the weekend - so doesn't read them til Mon. SS and Tc says they have to be signed Mon or no go - ever apparently Loan Lock expires and they hate him as much as I am starting to. And this was just the beginning. Get to his house FINALLY and upon greeting me and showing me in - he dead bolts (key on both sides) the door behind me. I guess I looked scared (I was) and he says something to the affect of not wanting his cats to get out. I ask for his ID and had advised him the lender required a copy in advance. He asked for my ID - I hate when they do that. Took my Id and PHOTOCOPIED MY ID. I was freaking out! This is when I am approached by a friendly seeming cat which causes me to relax a bit over the front door but not too much. And anyway-I'm cat people. He then picks up the cat by the neck but not in an affectionate mommy cat way. He then chucks the cat into an ajoining room and slams the door. So of course horror has spread over my face. Borrower finally sits as I am ready to jump out the window. So we proceed. Borrower won't sign this or that. Doesn't like the use of the word "extension" on his HELOC disclosure. After all, he has only just applied. I explain that the word extension is used to be the same as "offer" as one might extend ones hand in a greeting - as opposed to an increase (his understanding of the word) of some already existing loan. So he literally go and gets a dictionary, looks up the word and says he doesn't give "a shit what Webster has to say". At this point I am almost ready to cry and I am not the crying type. So I explain to him that I have been quite patient and I am done. He has refused to sign several different pages and is wasting my time and making me completely uncomfortable. (After already dialing 911 on my cell phone, in my pocket - although, I haven't hit send) I ask him to unlock the door as I wish to leave. I tell him I will call the police if he tries to hinder me. He unlocks the door all the while saying how rude I am being. How unprofessional I am to simply leave in the middle of a business matter. How I have been so demanding to require his ID and rude to act put out that he would expect to retain my information. And for what purpose??? So I finally make it to my car and call SS to explain what has happened and why I left and why only a small prtion of the docs were signed and to say I would not go back and they should not send another notary to this borrower under and circumstances. The guy is simultaneously on the phone with TC screaming about how unprofessional and rude I was to him. Of course SS paid me and apologized - TC and Lo call me and apologize too. They suspected he would be an ass but not a psycho ass. Anyway - I don't really know why I relayed that. I can just sympathize with you over some crazy clients.
