CA notaries please help!
NEVER seen a Name Affidavit worded like this and need some clarification.
Before me, the undersigned authority, a Notary Public in blah blah blah, on this day personally appeared John D. Doe
As Attorney in fact (Affiant), a credible person to me well and truly known, who, after been by me first duly and lawfully sworn upon oath deposes and states:
The Affiant is one and the same as
John Doe John Doe Jr.
Who is refinancing the property located at
123 Main Street Anytown, CA
After carefully reading the foregoing affidavit, the Affiant does hereby solemnly swear that the facts set forth herein are true and correct, to witness which Affiant hereunto sets hand and seals this 30 th day of September, 2005
(Signature line) John D. Doe
By _____________________________ as Attorney in fact
Sworn and subscribed by the above Affiant before me, the undersigned Notary Public on the 30th day of September, 2005
1) I’m thinking I should attach a Jurat Cert as this may not meet the criteria of the new Affiant statementin CA (although the doc does say he appeared before me, “a credible person to me well and truly known” doesn’t say proved to me on the basis of satisfactory evidence).
2) Since John D. Doe will be signing, should I line out the AIF capacity.
Any help is greatly appreciated. Signing is at 8 AM tomorrow and I just got the e-docs this evening.

In an affidavit the notary's certificate typically sandwiches the affiant's signed statement. With the venue, affiant's name at the top and the jurat wording at the end. The affiant is responsible for the signed statemnt in the middle. The notary is responsible for the venue, affiant's name at the top and the notarial wording at the end. If that wording is not the jurat wording of Ca then you must replace it with the correct wording.
