Conflict of Interest


I have been a notary for numerous years. I currently work part-time in a Reorders office. I haven't been notarizing docs for anyone in my county only surrounding areas. My boss, he
feels this is a conflict of interest for me doing this??? Any helps and suggestions would be appreciated on this matter. I don't want to give up either job. I like them both alot! Thanks!

I assume you meant Recorder's Office. If you are not notarizing anything that is recored in your office, I don't see the conflict. Why does your boss feel it is a conflict of interest?

If you do not notarize docs in your specific county, what's the conflict?

My boss said he'd get back to me... I talked to the head person in the court house and she
didn't feel there should be a problem... and Yes I did mean Recorders sorry for the typo.
I am from Iowa and enjoy all the people I meet. Thank you all for your imput too!

Even if you did them in your county, where is the conflict of interest. You were for a government office. Your do not reap any benfits becasue of the county work. If you worked for a large lending institution, then got your assignments becasue of your work with them I could see it. Do you think that maybe your boss is jealous of your extra income. Have you consider asking the county attorney their opinion of this? Don't think I would be discussing this as work anymore.

I don't see anything wrong with your notaring in or outside of your specific county, either. What would be the conflict of interest. You are in an impartial position in both your "day" job and as an NSA.

What state are you in and who paid for you bond and supplies? If you are in Calif. here is the information from the CA notary Handbook.

§ 8202.7. Private employers; agreement to pay premium on bonds and costs of
supplies; remission of fees to employer
A private employer, pursuant to an agreement with an employee who is a notary public,
may pay the premiums on any bond and the cost of any stamps, seals, or other supplies
required in connection with the appointment, commission, or performance of the duties of
such notary public. Such agreement may also provide for the remission of fees collected by
such notary public to the employer, in which case any fees collected or obtained by such
notary public while such agreement is in effect shall be remitted by such notary public to the
employer which shall deposit such funds to the credit of the fund from which the
compensation of the notary public is paid.
§ 8202.8. Private employers; limitation on provision of notarial services
Notwithstanding any other provision of law, a private employer of a notary public who has
entered into an agreement with his or her employee pursuant to Section 8202.7 may limit,
during the employee’s ordinary course of employment, the providing of notarial services by
the employee solely to transactions directly associated with the business purposes of the
employer.

While I agree with the others that there wouldn't seem to be any conflict of interest, in the way the private sector understands the term - there can be some quirks to the definition of "conflict of interest" as it applies to government employees.

My husband is a government employee, and has run into some of the broader definitions - generally applied to ANYTHING done 'on the side', as it applied to him. You may need to check into it from that perspective.

Michigan is not Iowa, however, I was a notary and worked at Register of Deeds for 7 years and as a notary PUBLIC I am there for the PUBLIC regardless of my employment.

When I worked the recording window, we were REQUIRED TO notarize if we were asked by a taxpayer (that's the way I look at it). Now if they didn't have ID or there was something amiss, we did not have to do it.

So not only did I "notarize" I then recorded the document and stamped the liber and page number on.

This policy was approved by Macomb County's Corporation Counsel.

You may want to ask your boss to check with your county attorney or your state's association of counties (if they have one) or the state attorney general's office.
