Title Docs and Lender Docs Discrepancy
Hello everyone - I am very new to this business - I have completed approximately 20 signings, so any help you can give me with the following question will be much appreciated! On my last three signings the title docs have the borrower's name one way, like with the middle initial, and the lender docs have the borrower's name without the middle initial. What is the correct way to handle this?

When we begin signing I always give the "I am a notary... yadie yadie". Which quickly leads into "please sign as your name is printed on each doc. Sometimes there's a middle initial sometimes there isn't. So just take a quick look at the preprinted name so that you sign as they have it typed."

Suppose I miss some and on docs that did not have middle initial they included middle initial. Will they have to be resigned?

Remember you have the borrowers copy so you have a fresh one to pull and have them sign accordingly. They can put the one with the incorrect signature in thier copy.

Yes, but suppose I'm thinking about this after the fact and I'm realizing I have made a mistake after sending the package. Will the title co. contact me and have me get these documents resigned?

I can't stress enough the importance of not putting yourself in that possition in the first place. The best way to handle it is keep an eye on them as they sign, check each page when it comes back to you, then when you are finished with the signing go through them all again. The best thing to do is not put yourself in the possition of having to do any resigning. If you do make a mistake they will call you, do all that you can to correct it. But again I'll just say more importantly double check everything before leaving. We really do need to be 100% accurate.

Thank you very much for your intelligent and to the point responses. I am very grateful for this forum where we can post questions and get straight answers. I will in the future take as much time (within reason) to check, double-check and triple-check my work prior to leaving the borrower's home. I did double-check - guess I need to triple-check!!!

Often the docs don't have a middle initial, yet the borrower has signed with the middle initial - this is their legal signature, they always sign with the middle initial. I have never had a problem with this (more not less than required) However if the docs have a middle initial and borrower does not sign with the middle initial there can be a problem.

I said I had never had a problem with a signer siging with their middle initial when it isn't on the docs - it finally happened!

Our job is to have them sign as printed and if you did that, you were absolutely correct. The Mortgage/DOT may still have to be resigned though.
This situation is where my services have added value to the title company. Many times the title docs will reflect how the deed is vested since title does the title search/committment. If you have more on the title docs, it could be the lender drew up the documents and missed the initial.
I call and ask. Many times, I am instructed to either 1. add the initial, 2. have them sign with an aka or htta (having taken title as), 3. add the variation to the name affidavit, or 4. do nothing at all. Many times, in the world of edocs, title only looks at the instructions and never lays hands on the docs so they might miss these discrepancies.
You were correct in having them sign as typed and you should get paid for doing your job. Asking title about these types of discrepancies will add value to your service possibly making you first call next time.
