Conflict of Opinion or Fact??

I was called to do a closing for a PURCHASE in New York for thursday. BankServ, the company who called me was telling me that I COULD do purchases for New York....

I told him/her that it is not legal for a Notary to conduct a closing for purchases in New York as it is an attorney state. However he/she kept trying to tell me otherwise.

Who is right??

I turned down the assignment in case anyone was curious. Any help is more than appreciated.

You may be able to find what you’re looking for here:

http://www.nysba.org/MSTemplate.cfm?section=Backs_Issues_(1998-Present)&template=/MembersOnly.cfm&ContentID=67229&MicrositeID=65

This is the Real Property Law section of the NY State bar association. You will have to create an online membership account for access. If I ever have any questions for my state, I always check my state bar association.

Also, when it comes down to the laws of my state, I never listen to the loan officer. I have been told on numerous occasions by loan officers that my state is NOT an attorney state.
