Received the same message as you did today. We can only hope he does what he said he's going to do!!!! I have been investigating him and he is well aware of my investigation and this is what I have found out so far. Sorry it is so lenghty!!!
I post this message to alert all notaries who have fallen victim to Dwayne Herberich and Katherine Herberich doing business as DCS Notary.com, DCS Mobile Notaries, Dakota Creek Services, Dwayne's Mobile Notary or Fieldcrest Bancorp, or Accredited Escrow, Fieldcrest Mortgage Corp.
The only DCS Enterprises, LLC registered in the State of California as of April 4, 2006 was canceled on 9/20/01. If Dwayne Herberich is doing business in California as a limited liabiliity company, it must be registered with the Secretary of State. So far his alleged LLC is not registered. Dwayne Herberich does have a Fictitious Business Nane Statements on file in the Orange County Recorder's Office and is doing business as follows:
Dwayne's Mobile Notary, registration #20026891578, files on 2/6/02, expires 2/6/07. DCS Mobile Notaries, registration #20046009964, filed on 12/8/04, expires 12/8/09. DCS Notary.com, registration #20056051271, filed on 11/23/05, expires 11/23/10.
Katherine Herberich has a Fictitious Business Name Statement on file with the Orange County Recorder and is doing business as Dakota Creek Services, registration #20016882181, filed 11/5/01 out of her home in Lake Forest. Katherine Herberich was also the Agent for Process of Dakota Creek Services, Inc. which corporation was suspended on 1/13/03. Katherine Herberich is also associated with Fieldcrest Mortgage Company, Fieldcrest Bancorp and Accredited Escrow. To what degree I will post later as I am still investigating her.
While I want to believe Dwayne's email is sincere, I have strong doubts. Based on his track record it appears that Dwayne Herberich, Katherine Herberich and Fieldcrest Mortgage Company are in the business of soliciting notaries who they have no intention of paying. I do not recommend any mobile notary taking a loan signing assignments from Dwayne Herberich, Katherine Herberich and/or Fieldcrest Mortgage or any company they are associated wiith. I will keep you posted as to my further research and findings.
I'd like to also say, while I am sorry for his father's illness, he has a business to run and an obligation to pay his notaries. He has had the time to take loan signings (For which I am sure he has been paid for) and pass them on to other notaries for which he has not paid them for. If he has time to send a letter to all the notaries he has not paid, then why can't he just write a check and send it to them.
