Jurat question... I need answer ASAP.

Hello everyone, I need some help...I have three forms that I need to notarize (1. Errors and omissions/compliance agreement 2.Occupancy Affidavit and Financial Status 3. Name Affidavit) apparently all these forms are asking for affirmations, all the forms say: “Sworn to and subscribe before me this ____ day of ____”. So I'm assuming they all require a Jurat stamp, Right? Unless my stamp doesn't fit, then I'll attach a loose Jurat Certificate, Right? I want to know if I can write in the Jurat verbiage instead, then place my notary seal? I'm confused, because I had a signing last night and the Error and Omissions Form had the same verbiage, I only filled out the date and stamped it without the Jurat verbiage, the weird thing is that escrow did not have a problem with the way it was notarized. What should I do?

You must not decide ...

... whether a jurat or acknowledgement (affirmation) is needed. That would be Unauthorized Practice of Law (UPL). The Notary just fills out the notarial block provided. Period.

If the wording says "Sworn to and subscribed ...", then you've got a jurat, which, by definition, requires an oath. Don't over-think things. There's no need for "a jurat stamp"; the wording is already present.

There is a need for a jurat stamp if it's jurat wording that doesn't comply with California law.

What is preprinted on the document?

If there is NO certificate there, then you do not need to notarize the signatures on the document.

If there IS a certificate and it begins with "Sworn to" (or affirmed), then you need to complete the JURAT. If the preprinted jurat is not state compliant, then you need to modify it or attach a loose jurat to the document.

If there IS a certificate and it states "acknowledged", then you need to complete the ACKNOWLEDGMENT. If the preprinted acknowledgment is not state compliant, then you need to modify it or attach a loose acknowledgment to the document.

Good Morning Eileen.

I think I understand your question.. The jurat that is preprinted on the form does not have the exact wording required by your state, correct? Since I am not in your state, I cannot give advice. I did see this subject discussed not too long ago. Have you tried to search on Jurat.

In my state, if the verbiage is incorrect, I will attach a loose jurat or acknowledgement.

Aileen - The Jurat Verbiage you Described is NOT compliant

You must use the new verbiage that indicates you also verifiied the identity of the affiant(s). The wording you described is no longer legal in the State of California (since Jan 2005)

You can purchase a Jurat stamp on this site (or many others) with the new wording or download a free jurat (loose certificate) from the website at notaryclasses.com homepage (or many others).

PS You might want to consider updating your profile to increase your opportunities for work!

This is basic notarial knowledge.

If you are asking this question, you need to go back to square one and start re-reading your state's Notary Manual.

And you defiantly should NOT be completing any more signings until you are completely proficient in your Notary Public position.

100% correct too. I just figured I'd beat somebody else to the punch.

Seriously people, if you don't know how to fill out a jurat or acknowlegement without help or confirming what you did really is correct, you're not ready to do loan signings.

Thank you everyone for all your answers you were very helpful and kind! But, someone always has something smart to say…So for the rest that had rude answers, like Tina (Don't hate) I think you all forget that you were once new at this, but now think you are too good for this game, Right? I don't care what you think! People like YOU (Rude, Smartass, Obnoxious) are the ones that drive me to be the best that I can be! So get a life!!! Don't bother in answering you’re not worth my time, I actually have signings to do!!!
