Need advice re: non payment from SS

Im having problems with a signing service who has been real happy with me until now. Out of the 3 years that I have been a notary, I've never had problems. I got a call from the SS to do a signing for a borrower that I have signed quite a few times in the last 2 months. It was month end and I had 8 appts in one day and asked the SS if we could do it tomorrow instead, it may be very late before I meet with them. SS said that borrowers were too busy the next day and would really like to meet that night, borrowers requested lender to send me to do the signing so I wanted to accomodate them. My last appt had problems and ran really late so I called borr. and they said tomorrow was fine, they werent busy at all. I emailed SS to let them know we would be signing the day after instead. When I finally spoke with SS, they said the docs had to be dated the original signing date, which they failed to mention, and that I screwed up and now they have to send another notary.

They are now telling me I cant get paid at all for the 2 loans that I signed on that saturday night. SS said they almost lost the client (lender) because of me and now wont use me anymore. Borrowers called me upset because lender would not send me back to them anymore, lender told them I was too busy for them and they wanted to know if that was true, these borrowers grew close to me (they had given me a gift the last time I saw them). This really upsets me because I have always tried to accomodate this SS with last minute appts and feel that they are not being fair. Since this has never happen to me, I want to know what you would do in this situation.

If you have been doing this 3 years, you should know that MOST of the time, docs ARE date sensitive and need to be signed on the date they are dated. In any event, you certainly can't assume they are not date sensitive and change an appointment date to suit your OWN schedule because YOU overbooked and had too many appts to handle in one day. So you blew this one.

If you completed the other assignments successfully, I would say you should be paid for the work you completed, as they have nothing to do with the one you messed up on. If you've had a good relationship in the past, hopefully you can salvage it, but what you did is a major
no-no.

I'm with Roger. You goofed.

Overbooking is A Bad Thing. It will bite you eventually, if not sooner.

As for the other signings, you should get paid. Just don't expect any future work from that signing service.

Learn the lesson the hard way, then move on.

I agree 100% with Charles. Furthermore...

I find it stunning that you've been doing this for three years and thought that you could just do a signing on a different day.

AL is right...why do people even tell this because it does not sound plausible.

Well what threw me off was when I mentioned if we could do it the day after the SS said borrowers were too busy the next day, typically, they would tell me that the docs are date sensitive and lender needs it signed. I dont usually reschedule, I always make my appts, this day was a bad one.

"I emailed SS to let them know we would be signing the day after instead."

Who are you to decide that docs can be pushed back a day? Did I miss something? Since WHEN does a signing agent take on the role of lender and decide to change the signing date?

Yes, you should be paid for the other jobs from the same day. But you should Never and I mean NEVER make a descision to change the signing day without notifying the person that hired you. You should have excused your self from the signing that took a long time and called the signing service that hired you and explained that you were running too late to close the last loan. SS could have sent another signing agent to you to pick up docs and complete your last sign.

Yes you goofed, but the customers have a right to request you anyway. I would have them contact the lender. The SS owes you for any signings you did complete correctly. I would contact the lender or title company and work directly for them from now on and since the SS wants to cut you out for one mistake, I would do my best to cut them out. Good luck

I agree, you made a mistake. Who is this company that thinks they can not pay you for the other 2 closings that you completed?

Two wrongs

First, you screw up big time for overbooking. Second, SS have no right to forfeit payment for previous job completed.
