Not OT Gender Identity

Article in today's Chicago Tribune regarding the above issue, Please find link below

This is not intended to be judgemental. I am of the "hey, whatever floats your boat"
school.
There was a recent post here about a CA signing where the bwr's apprearance was male
and the DL said female. (might have been vice-versa but the issue would be the same)
The CA acknowledgement form (which I understand is mandatory) has language for
"he/she/they and his/her/their" I would imagine that one of these must be selected
Other states, and most forms in loan docs have identical provisions.
How do you handle this when the gender of single signer is unclear, or they claim
a gender at varince with their ID?
There are clearly more significant issues facing the world, at this time, but
I believe that a discussion of this issue would be warranted on this type of forum.

I didn't read the article Bob, but my opinion is... if one is a cross dresser, they would be what they were born as. If one got a sex change operation, they should change their ID to reflect same. I would go by their ID, because I don't know any better.

Couldn't get through to your link. But my opinion is that I would go with what ever their government issued id stated, i.e. male or female. If it's a cross dresser then they are definitely in their birth sex, if it's a person in transition, their gender will not become official until after their surgery. Either way, it's not my position to pass judgement so I would go with what I am legally obligated to do. So until then, it is what it is.

Bwrs says, I don't care what DL states, I am a (wo)man
I insist that you identify me as such on your ack form
If identity of bwr has been clearly established, does the gender
as stated on ID form really matter for notary purposes. I personally do
not think so , but it is an interesting question.

Bob, I looked at the Chicago Tribune registration form, and noticed they will send me e-mail if I sign up. I decided to not sign up because of that. Could you summarize any key points from the article?

Then you tell the borrower (in nicer words than this of course) "I don't care what you consider your gender to be, I have to follow federal laws. For purposes of filling out my acknowledgement, if you have a penis you're a man, if you have a vagina you're a woman".

Honestly, I doubt you'd run across that many pre-op transexuals who would make an issue out of this. They're well aware of the legalities regarding gender identity and what it takes to legally make the transition.

If anyone finds this subject interesting you should watch the new season of "Surreal Life" on Vh1. Alexis Arquette is one of the castmates and she's a pre-op tranny. It's definitely illuminating to see how she deals with it and all that goes along with it.

Gender could matter in establishing ID. Suppose LO talked with what they believed to be a male & the person signing before you is clearly female (or vice versa). Suppose name is Kerry or Austin, Madison, the list goes on. How can you ensure that the person signing before you is the "real" borrower. I have a brother-in-law named Morgan who got teased growing up due to Morgan Fairchild. What if his last name was Fairchild...they're NOT the same person.

I don't know what the answer is, but just wanted to provide a different take on the question posed.
