Notarization deduction question ...

This question has come up quite often in our office and I can't find the publication on the IRS site to answer it.
In the State of Colorado, is the notarization deduction per notarization or per notarized page? I thought I read it was $5.00 deduction per notarization.

Each State is different. In Michigan it is $10 per signature.

I believe it is $10 per notarization in Michigan Jan, not per signature.

It is per notarial act. That means each individual oath, signature witnessed...
e.g. You have an affidavit that someone needs to sign and you witness. Swear them in (1), witness their signature (1), total = 2

According to the statutes here in CO your example would only be 1 act and $5.00 maximum charge. From the statutes: "The fee for each such document shall include the following incidental services of such notary: (a) Receiving evidence of such person's identity as enumerated in section 12-55-110 (4); (b) Administering an oath or affirmation to such person; and (c) Signing and sealing a certificate or statement of such notary that is included in or attached to such document and evidences that the document was attested before such notary."

"A notary is entitled to receive a fee of no more than two dollars ($2.00) for each oath or affirmation administered or for each signature notarized." The way I read this is that you can ONLY charge for one or the other act, not both, so in essence if you have 2 signers and you administer an oath to both of them and notarize both signatures you can only charge $4.00 max.

As Sign/Seal pointed out, Colorado's law is different than Wyoming's.

Anyway, Maryann is correct. You didn't find it on the IRS site as it's a state thing, not federal.
