Payment Question
SS called me today to make me aware that the check they sent was dated for July 3rd. Quickbooks printed wrong address on the check. I was one of 25. The check wasnt for full amount still missing one invoice. 2 out of the 3 invoices are approcahing 60 days. He asked that I send the check back to them and he will send me a corrected one.
My issuse is that I am at the point to say I am through with closing their loans cause I am tired of chasing a payment. This has just started last 4 months....What would ya do?

I'm cynical. If the SS had sent me a check dated several months in the future, I'd assume they were playing games with me. I'd also probably see if my bank would process that check rather than waiting for the SS to send me another check, but I'm cynical, remember that.

I find it understandable that their software would erroneously assign a date in the future. Computer nonsense happens.
I would be nice until I received all money owed.
Then I would tell them to take me off their list.
If I didn't get payment by 90 days, I would invoice them for late fees and file a small claims court fee. Plus I would let them know that I have the correct address for filing a business license and secretary of state complaint in THEIR state and would do so in ten days.

It is my understanding that if you accept a post-dated check, it's like making a loan to the person who wrote the check. If it's no good later...oh, well... gee, they didn't repay your 'loan'. As to what you should do.... haven't a clue.

In Connecticut a post dated check has a status similar to a promissory note. If you hold the check, it gives rise to a defense argument that the case has been settled in the event that you try to secure payment prior to the July date. You should make a copy of the check for your records. It is an admission on the part of your client that there was no problem with your work if that should later become an issue.
You should return the post dated check to your client after having made a copy of it, and demand payment in full by a properly dated check. If there is a problem, follow the usual collection procedures.

I received a check dated in June when it should have said January. The bank never blinked or batted an eye at it. I just deposited it when I received it--in January.

I'd tell them that I'll hold the check until I recieve payment. All the SS would have to do is stop payment on the check.
That would tick me off because now I'd have to wait even longer to recieve payment.

Sounds like thier playing games with you...
When a company is already late on payment (aka cash flow shortage during slow time), they "accidentally" print checks incorrectly and it's not even for the correct amount; I would be very suspicious. The fact that this has just started over the past 4 months is the give-a-way. The check's not any good until July so I would send it back. Did they even date it 2006? Or 2005?..lol.
I would also send them final notices on the invoices that clearly state your collection policy ..and once payment is received; cut them loose.
BTW, if you signed a contract with them, and it state's that they will pay you within 30 days; once they made the first late payment, they broke thier own contract. Just, fyi, in case you're concerned about it.
