Poor Notarization

Tonight I had a very troubling experience. I was closing a previously recinded loan for a very nice couple in Maryland. As I was entering the items of notarization in my notary journal, they asked what I was doing. Apparently last week when another notary closed their loan there was no notary journal. I asked if she at least had them sign her book, as some notaries like to fill the specifics later, they said no they never saw her journal. In Maryland a journal is required!!! Shouldn't a notary know that basic information?

Yeah, a journal is required. However it does not have to be a "book". I have my own journal that I made up myself which looks nothing like a book and meets all the requirements in the Maryland notary guide. Perhaps your clients were confused when they did not sign a "book" like yours, but may have signed a document which would later be added to the notary's journal.

I like your idea of a journal "page." It sounds like you keep your journal on computer. Is this correct? I have been using the hardcover journal I purchased here for the last two years and love it. However, I'd love one less thing to carry.

Am I correct to assume that you keep a template of the page on your computer? Or do you actually keep the journal (aka fair register) on your computer? If the latter, how do you acquire the signer's signature?

Just curious, as FL does not require the use of journals, and many folks have asked about "computerized" journaling. (Enjoya is not what they have in mind.) I have been thinking about creating a computer journal for these situations.

I've often thought about a single page to take to the individual signings and either keep a book to insert them into or scan them into my computer for keeping. Just not sure if I want that info in my computer in the event of a virus or hacker and if I keep the pages in a book, I'm afraid of misplacing a page before I get it inserted or if it tears out without my knowing.
Additionally, creating a file system if I scan them in to allow me to search one up at any given time. I'm not that big of an organizer. Smile

Wow, that's a lot to assume just because the borrowers don't remember the previous notary's journal. It could be that they don't remember a journal because of the issues that caused them to rescind.

When I get calls to get affidavits signed from pervious closings. The borrowers can't even remember the LTP names.

here lately, my "fixers" are for the same gentleman. I don't have to worry if the borrower can remember names! And yes, he's a LTP, just not a good one.

No he's not. I know the one you're speaking of, but not him. I should really thank the guy I'm speaking of. I have made quite a tidy sum fixing his errors.

Opps typo! Not all of mine have been to fix mistakes of the LTP. Some have been title companies error.

I know the one you're speaking of Traci. He's the retired guy that travels the entire state for $75. and makes lots of mistakes.
