Seeking opinion on CA journal
There has been some question on the other board about how to enter into the journal. Some people enter every jurat and ack on a different line and have borrower sign each line. For instance, if you have 5 docs and 2 brws you have 10 lines and 10 signatures. I use the notrot journal and have just been checking the appropriate boxes and having each brwr sign once. I was told that was incorrect. I called the SS and they said refer to gov code 8206. I still don't find this a definitive answer. Your opinions please. tia

Hello,
If you do a quick search here on NotRot you'll find that this topic has already been discussed.
From what I gather from other members currently from California, you only have to fill in the brws information once and list each document you've notarized for them. Therefore, the brws should only have to sign once.
It's crazy to think that you have to use a separate line/space for each and every document you notarize!
Just keep in mind that this deals with per notarial event......... if the same brw(s) appear before you on a different date or time, then YES... you must record a different entry in your journal.

Thanks Korey. I did do a search before I posted. I agree with you it seems unreasonable to ask the borrower to sign a number of times. The SS did say we should enter on each line and have them sign once and draw a diagonal line through the signature boxes. The gov code just doesn't seem clear to me. I'm just curious what others do.

I use one line per jurat or ack. I then draw a line thru the required signatures and ask them to sign once on the diagonal line (provided it's all on one page). I always wondered myself if this is overkill as well.

I use the NR journal, check off and/or identify the documents and have them sign once.

What is not definitive about the answer? I just read the code and there is nothing in there about the information having to be in separate journal entries. There is nothing that even remotely implies that to be the case.
It simply says we must have the date, time, type of notarization, type of document and signature. Based on that, why on earth would you think what you're doing is incorrrect?

When approriate check the boxes, the big space below is used to write in things that have no box. The only time I use two lines is if there are unrelated signers as in a purchase or a Quit Claim Deed with grantor and grantee. I use one line if its a husband and wife, and both are borrowers. In Maryland most of the notarized Docs need to be signed by the none borrowing spouse, so one line usually works fine. Notrot journal has space for two signers and their Id's on one line.

Just be thankful that the Notary Rotary Journal is compliant.
