THE NOTE
stupid question...on the 5th page of the note there are 4 lines-one has borrs sig ...where do I sign. On any of the other lines??????? They all say (seal) at the end of the line like this..._________________________(seal) Name:
Also, If you mess up....just draw a line and initial..right?

Seal does not mean "your seal" it refers to the borrowers signature. You should not be required to sign the Note.

The seal is equivalent to their signature.
So the note doesn't have an acknowledgment, jurat, etc. already pre-printed on it? Maybe you don't have to notarize it. Again, the seal is the same thing as signature.

Sometimes the note is notarized. I have had signings that the note needed to be notarized and almost missed it. I was operating under the "assume" theory and we all know what that will get ya! b.

There I go again, violating my own rules. I rarely post on this board, or any other. My main reason for not posting is that I am loathe to post anything that may be inaccurate. Although I have 17 years experience in the title industry, my knowledge is largely confined to my home state. I once posted on this board criticizing another for so freely stating practices of a state where he/she did not reside or practice.
I thought I was safe on this one. In my entire time in the industry, I have never seen a note that was to be notarized.

Don't be to hard on yourself. I've done this before, and I've be corrected. I think everyone has done this a time or two. You had good intentions and a least can admit it, when it was a mistake. You do notarize the Note in some states - VA is one of them. But it's easy to tell they want it notarized because there is a notary block under the borrower's signature line.

Yes, there are some states that do. I just did one for VA last week, and specifically remember notarizing the note. There are also other states, but I do not recall which others require it.

Okay I replied to this once already but wanted to restate. I'm in Florida and I have had loans that the note was to be notarized. Not offten but it has happened. It was a Florida property. Read your documents to check.

Excellent advice Bev.........
SA's get hammered in here daily because of "state specific" laws, we need to remember that the lenders requirements are as varied as each grain of sand. I have a lender who continually amazes me with their requirements and wouldn't I look foolish if I said "but no one else does this". They are all tightening up their requirements due to fraud and personally I think it was a good catch that anon made. That's what it's all about, paying attention to each and every doc because the moment we become less aware...that's the moment of the big boo boo.
