This is a matter of state real estate law, not notary law. You do not want to get into UPL, but as a professioal NSA, you should know if the signature of a spouse may be necessary on certain loan docs even if they are not named on the title as an owner of the property. A local atty of T/C might be a good source of info.

When I first started as an SA, I called the SOS. They had no clue what I was talking about. I probably wasn't asking it right. I called the nna and they said yes for my state. I started checking when I got docs I would double check with the SS or whatever and they verified that yes I am in a spousal state. I do watch this on all loan docs though cuz sometimes it is missed and they are very grateful that I catch it.

Not in California they're not. I've done a zillion loans where the borrower is married but the spouse isn't on the loan or title and doesn't have to sign anything.

Define "spousal states" California is a
community property state, as are many states.
